AMENDMENT TO SENATE BILL 1007

2    AMENDMENT NO. ______. Amend Senate Bill 1007 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Counties Code is amended by changing
5Section 3-5015 as follows:
 
6    (55 ILCS 5/3-5015)  (from Ch. 34, par. 3-5015)
7    Sec. 3-5015. Certificates of discharge or release from
8active duty. Certificates of discharge or MEMBER-4 copy of
9certificate of release or discharge from active duty of
10honorably discharged or separated members of the military,
11aviation and naval forces of the United States shall be
12recorded by each recorder, free of charge, in a separate book
13which shall be kept for the purpose. The recorder in counties
14of over 500,000 population shall as soon as practicable after
15the recording of the original discharge certificate or MEMBER-4
16copy of certificate of release or discharge from active duty,

1deliver to each of the persons named in the discharge
2certificate or MEMBER-4 copy of certificate of release or
3discharge from active duty, or his agent, one certified copy of
4his discharge certificate or MEMBER-4 copy of certificate of
5release or discharge from active duty without charge.
6Additional certified copies shall be furnished by the recorder
7upon the payment to the recorder of a fee of $1.25, payable in
8advance, for each such additional certified copy.
9    Upon the delivery of the certificate of discharge or
10MEMBER-4 copy of certificate of release or discharge from
11active duty after the recordation thereof is completed, and the
12delivery of one certified copy thereof to the person named in
13the discharge certificate or MEMBER-4 copy of certificate of
14release or discharge from active duty or his agent, the receipt
15theretofore issued by the recorder, or a copy thereof shall be
16surrendered to the recorder, with a signed statement
17acknowledging the receipt of the discharge certificate or
18MEMBER-4 copy of certificate of release or discharge from
19active duty and the certified copy thereof.
20    Certified copies of the certificates of discharge or
21MEMBER-4 copy of certificate of release or discharge from
22active duty furnished by the recorder may vary from the size of
23the original, if in the judgment of the recorder, such
24certified copies are complete and legible.
25    A military discharge form (DD-214) or any other certificate
26of discharge or release from active duty document that was

1issued by the United States government or any state government
2in reference to those who served with an active or inactive
3military reserve unit or National Guard force and that was
4recorded by a County Clerk or Recorder of Deeds is not subject
5to public inspection, enjoying all the protection covered by
6the federal Privacy Act of 1974 or any other privacy law. These
7documents shall be accessible only to the person named in the
8document, the named person's dependents, the county veterans'
9service officer, representatives of the Department of
10Veterans' Affairs, or any person with written authorization
11from the named person or the named person's dependents.
12Notwithstanding any other provision in this paragraph, these
13documents shall be made available for public inspection and
14copying in accordance with the archival schedule adopted by the
15National Archives and Records Administration and subject to
16redaction of information that is considered private under the
17Illinois Freedom of Information Act, the Federal Freedom of
18Information Act, and the Federal Privacy Act.

20    Section 99. Effective date. This Act takes effect upon
