AMENDMENT TO SENATE BILL 1236

2    AMENDMENT NO. ______. Amend Senate Bill 1236, AS AMENDED,
3with reference to page and line numbers of House Amendment No.
41, on page 4, by replacing lines 1 through 20 with the
5following:
 
6    "(a) As used in this Section, "familial relationship" means
7an individual's father, mother, son, daughter, brother,
8sister, uncle, aunt, great aunt, great uncle, first cousin,
9nephew, niece, husband, wife, grandfather, grandmother,
10grandson, granddaughter, father-in-law, mother-in-law,
11son-in-law, daughter-in-law, brother-in-law, sister-in-law,
12stepfather, stepmother, stepson, stepdaughter, stepbrother,
13stepsister, half-brother, half-sister, and the father, mother,
14grandfather, or grandmother of the individual's spouse and the
15individual's fiance or fiancee.
16    (b) A county may deny, suspend, or terminate the
17eligibility of a person, firm, corporation, association,

1agency, institution, or other legal entity to participate as a
2vendor of goods or services to the county if the vendor, for
3contracts greater than $30,000, fails to disclose to the county
4a familial relationship between a county elected official or
5county department director and any of the following individuals
6who have the authority to act on behalf of and with the power
7to bind the respective person, firm, corporation, association,
8agency, institution, or other legal entity: a corporate
9officer; a member of the corporate board of directors; a
10limited liability company manager; a member with management
11authority of a limited liability company; or a partner of a
12partnership.
13    (c) If a person, firm, corporation, association, agency,
14institution, or other legal entity seeking to contract with the
15county has a familial relationship required to be disclosed
16under subsection (b), then the contract may be approved or
17renewed by roll call vote of the county board following a
18recitation of the name of the county official and the nature of
19the familial relationship being disclosed."; and
 
20on page 4, line 23, by replacing "5" with "10"; and
 
21on page 4, line 24, by replacing "county clerk" with "county
22board chairperson, county board president, or county
23executive".
