AMENDMENT TO SENATE BILL 1307

2    AMENDMENT NO. ______. Amend Senate Bill 1307 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Genetic Information Privacy Act is amended
5by adding Section 31.11 as follows:
 
6    (410 ILCS 513/31.11 new)
7    Sec. 31.11. Uses and disclosures for marketing,
8advertising, or sales. It is unlawful for any person or
9business to disclose an individual's genetic information to
10third parties specifically for marketing, advertising, or
11sales purposes unless the individual, or his or her legal
12guardian or legally authorized representative, consents in
13writing to the disclosure. Any request for consent to disclose
14an individual's genetic information to third parties for
15marketing, advertising, or sales purposes must be provided in a
16written notice separate from any other communication that

1clearly and conspicuously states how the information will be
2disclosed, including to whom the information will be disclosed
3and how the information will be used by the recipient, seeks
4the individual's, or his or her legal guardian's or legally
5authorized representative's, consent to disclosure, and
6informs the individual, or his or her legal guardian or legally
7authorized representative, of how to cancel consent to
8disclosure once given.".
