1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Public Health Powers and
5Duties Law of the Civil Administrative Code of Illinois is
6amended by adding Section 2310-236 as follows:
 
7    (20 ILCS 2310/2310-236 new)
8    Sec. 2310-236. Form of coroner's report; sudden unexpected
9infant death and sudden infant death syndrome.
10    (a) The Department shall develop and require the use of a
11form by coroners in the case of a death of an infant in which
12the cause of death is sudden unexpected infant death or sudden
13infant death syndrome. The form shall contain, at minimum, the
14following information to be recorded after a preliminary
15investigation:
16        (1) The date and time of death.
17        (2) The county of occurrence and the county of the
18    infant's residence.
19        (3) Relevant demographic details regarding the infant,
20    such as date of birth and gender.
21        (4) Relevant demographic details regarding the parents
22    or caretaker of the infant.
23        (5) Relevant details regarding the circumstances of

1    the death, including, but not limited to, who found the
2    infant, where, and what they did.
3        (6) Relevant details concerning where the infant was
4    placed, by whom, and in what position.
5        (7) Any additional relevant details concerning the
6    sleep environment that the infant was placed in and what
7    environmental factors were present, to the extent that
8    those factors are ascertainable.
9        (8) Relevant details concerning health hazards present
10    in the sleep environment, to the extent that those health
11    hazards are ascertainable.
12        (9) Relevant details concerning the infant's medical
13    history and previous medical issues.
14        (10) Other information the Department may determine to
15    be relevant and conducive to understanding and recording
16    the circumstances of the infant's death.
17    (b) The Department shall publish current information
18concerning sudden unexpected infant death and sudden infant
19death syndrome.
20    (c) At least once every 5 years, the Department shall
21review the form and determine whether updates need to be made
22for effectiveness and relevancy.
 
23    Section 10. The Counties Code is amended by changing
24Section 3-3016 as follows:

1    (55 ILCS 5/3-3016)  (from Ch. 34, par. 3-3016)
2    Sec. 3-3016. Sudden unexpected infant death and sudden
3infant death syndrome. Where an infant under one year 2 years
4of age has died suddenly and unexpectedly and the circumstances
5concerning the death are unexplained following investigation,
6an autopsy shall be performed by a physician licensed to
7practice medicine in all of its branches who has special
8training in pathology. When an autopsy is conducted under this
9Section, the parents or guardian of the child shall receive a
10preliminary report of the autopsy within 5 days of the infant's
11death. All suspected sudden unexpected infant death and sudden
12infant death syndrome Sudden Infant Death Syndrome cases shall
13be reported to the Statewide Sudden Unexpected Infant Death
14Syndrome Program within 72 hours.
15    Death certificates shall list the cause of death as sudden
16unexpected infant death or sudden infant death syndrome Sudden
17Infant Death Syndrome where this finding is medically justified
18pursuant to the rules and regulations of the Department of
19Public Health. Copies of death certificates which list the
20cause of death of infants under one year 2 years of age as
21sudden unexpected infant death or sudden infant death syndrome
22Sudden Infant Death Syndrome shall be forwarded to the
23Department of Public Health within 30 days of the death with a
24report which shall include an autopsy report, epidemiological
25data required by the Department and other pertinent data.
