AMENDMENT TO SENATE BILL 1970

2    AMENDMENT NO. ______. Amend Senate Bill 1970 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Election Code is amended by changing
5Sections 7-42 and 17-15 as follows:
 
6    (10 ILCS 5/7-42)  (from Ch. 46, par. 7-42)
7    Sec. 7-42.
8    (a) Any person entitled to vote at such primary shall, on
9the day of such primary, with the consent of his employer be
10entitled to absent himself from any service or employment in
11which he is then engaged or employed for a period of two hours
12between the time of opening and closing the polls. The employer
13may specify the hours during which said employe may absent
14himself.
15    (b) Beginning the 15th day before the primary election or
16on the day of the primary election, any student entitled to

1vote at such primary shall be entitled to be absent from school
2for a period of 2 hours during the school day in order to vote.
3The school may specify the hours during which the eligible
4student may be absent. A student who is absent from school
5under this subsection (b) is not considered absent for the
6purpose of calculating enrollment under Section 18-8.15 of the
7School Code.

10    Sec. 17-15.
11    (a) Any person entitled to vote at a general or special
12election or at any election at which propositions are submitted
13to a popular vote in this State, shall, on the day of such
14election, be entitled to absent himself from any services or
15employment in which he is then engaged or employed, for a
16period of 2 hours between the time of opening and closing the
17polls; and such voter shall not because of so absenting himself
18be liable to any penalty; Provided, however, that application
19for such leave of absence shall be made prior to the day of
20election. The employer may specify the hours during which said
21employee may absent himself as aforesaid, except that the
22employer must permit a 2-hour absence during working hours if
23the employee's working hours begin less than 2 hours after the
24opening of the polls and end less than 2 hours before the
25closing of the polls. No person or corporation shall refuse to

1an employee the privilege hereby conferred, nor shall subject
2an employee to a penalty, including a reduction in compensation
3due to an absence under this Section, because of the exercise
4of such privilege, nor shall directly or indirectly violate the
5provisions of this Section.
6    (b) Beginning the 15th day before a general or special
7election or any election at which propositions are submitted to
8a popular vote in this State or on the day of a general or
9special election or any election at which propositions are
10submitted to a popular vote in this State, any student entitled
11to vote at such election shall be entitled to be absent from
12school for a period of 2 hours during the school day in order
13to vote. The school may specify the hours during which the
14eligible student may be absent. A student who is absent from
15school under this subsection (b) is not considered absent for
16the purpose of calculating enrollment under Section 18-8.15 of
17the School Code.
