AMENDMENT TO SENATE BILL 2052

2    AMENDMENT NO. ______. Amend Senate Bill 2052 on page 18,
3line 18, by replacing "2" with "4"; and
 
4on page 18, line 19, by replacing "or" with "and"; and
 
5on page 18, line 22, after "reasons", by inserting "(not
6including water disconnection)"; and
 
7on page 19, line 9, after the period, by inserting
8"Additionally, the municipality shall give notice in a
9newspaper of general circulation published in the municipality
10of the municipality's intent to have the property declared
11abandoned; a judicial deed may not be issued under this
12subsection unless the municipality has provided the court a
13copy of the newspaper notice and at least 30 days have passed
14since the newspaper notice was published."; and

1on page 23, line 5, after the period, by inserting "The amount
2of extinguished tax liens, delinquent taxes, and any taxes due
3on or after the issuance of the judicial deed shall be paid by
4the municipality or public agency to whom the judicial deed was
5issued out of proceeds of the sale of the property, if any.";
6and
 
7on page 23, immediately below line 5, by inserting the
8following:
 
9    "If a judicial deed was issued to a public agency under
10this subsection, the public agency must first provide
11exclusively to low-income, owner-occupied purchasers a
12"first-look period" of no less than 30 days after the issuance
13of the judicial deed. During the first-look period, property
14obtained under this subsection may not be offered to such
15individuals in an amount more than 50% of the property's fair
16market value and must be advertised in a multiple listing
17service or other similar information source. After the
18first-look period has expired, the public agency may offer
19property at an amount determined by the public agency.".
