    Amends the Food Handling Regulation Enforcement Act. Prohibits a public health district from regulating the preparing and serving of food in a private residential leasehold that is prepared by or for the lessees and consumed by the lessees and their guests.

1    AN ACT concerning health.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Food Handling Regulation Enforcement Act is
5amended by changing Section 3.7 as follows:
 
6    (410 ILCS 625/3.7)
7    Sec. 3.7. Communal kitchen in private residential
8leasehold.
9    (a) As used in this Section, "private residential
10leasehold" means a private residential structure not open to
11the public which is leased to more than one person and contains
12a communal kitchen used by the lessees and guests of the
13lessees.
14    (b) Notwithstanding any other provision of law, neither the
15Department of Public Health, nor the health department of a
16unit of local government, nor a public health district may
17regulate the preparing and serving of food in a private
18residential leasehold that is prepared by or for the lessees
19and consumed by the lessees and their guests.
20    (c) This Section does not apply to regulation of private
21residential leaseholds in municipalities with a population
22greater than 1,000,000.
