Amends the Animal Welfare Act. Provides that if a person or entity fails or refuses to pay an administrative fine imposed by the Department of Agriculture for a violation of the Act, the Department may prohibit that person or entity from renewing a license under the Act until the fine is paid in full. Provides that any penalty of $500 or more not paid within 120 days of issuance by the Department shall be submitted to the Department of Revenue for collection as provided under the Illinois State Collection Act of 1986. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Animal Welfare Act is amended by changing |
5 | | Section 20.5 as follows: |
6 | | (225 ILCS 605/20.5) |
7 | | Sec. 20.5. Administrative fines. The following |
8 | | administrative fines shall be imposed by the Department upon |
9 | | any person or entity who violates any provision of this Act or |
10 | | any rule adopted by the Department under this Act: |
11 | | (1) For the first violation, a fine of $500. |
12 | | (2) For a second violation that occurs within 3 years |
13 | | after the first violation, a fine of $1,000. |
14 | | (3) For a third violation that occurs within 3 years |
15 | | after the first violation, mandatory probationary status |
16 | | and a fine of $2,500.

17 | | If a person or entity fails or refuses to pay an |
18 | | administrative fine authorized by this Section, the Department |
19 | | may prohibit that person or entity from renewing a license |
