SYNOPSIS AS INTRODUCED:
 
70 ILCS 1205/2-17.5

    Amends the Park District Code. Provides that the 3 2-member districts of the Fox Valley Park District shall be referred to as subdistricts. Provides that the subdistrict commissioners shall reside within the subdistrict from which he or she is elected. Adds nominating petition requirements for subdistrict commissioners and the at-large commissioner. Makes other changes.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Park District Code is amended by changing
5Section 2-17.5 as follows:
 
6    (70 ILCS 1205/2-17.5)
7    Sec. 2-17.5. Fox Valley Park District.
8    (a) The Fox Valley Pleasure Driveway and Park District is
9reorganized by operation of law as the Fox Valley Park District
10under this Code on July 16, 2014 (the effective date of Public
11Act 98-772) this amendatory Act of the 98th General Assembly.
12    (b) Each Fox Valley Park District commissioner shall be a
13legal voter and reside within the park district and, as to the
14subdistrict commissioners, each shall reside within the
15subdistrict from which he or she is elected. The proper
16election authority shall conduct the elections for
17commissioners at the time and in the manner provided by the
18general election law.
19    (c) Beginning with the consolidated election in 2017, 7
20commissioners shall be elected for 4-year terms, consisting of
216 commissioners from 3 2-member subdistricts districts, and 1
22commissioner elected at large. The terms of office of the
23initial commissioners elected under Public Act 98-772 this

1amendatory Act of the 98th General Assembly will run as
2follows, to be determined by lot: 4 members shall serve a
34-year term and may be re-elected for subsequent 4-year terms,
4and 3 members shall serve a 2-year term and may be re-elected
5for subsequent 4-year terms thereafter.
6    The initial three subdistricts districts of the Fox Valley
7Park District shall be as follows:
8        (1) Those portions of Kane County and Kendall County
9    west of the Fox River.
10        (2) Those portions of Kane County and Kendall County
11    east of the Fox River and south and west of a line
12    following Indian Trail Road from the center line of the Fox
13    River easterly to the intersection with Farnsworth Avenue,
14    then southerly along Farnsworth Avenue to the intersection
15    with the Burlington Northern Santa Fe Railroad, then
16    easterly to the county line.
17        (3) Those portions of the district in DuPage County and
18    Will County and that portion of Kane County generally north
19    and east of a line following Indian Trail Road from the
20    center line of the Fox River easterly to the intersection
21    with Farnsworth Avenue, then southerly along Farnsworth
22    Avenue to the intersection with Burlington Northern Santa
23    Fe Railroad, then easterly to the county line.
24    In the year following the next decennial census and each
25decennial census thereafter, the board of commissioners shall
26reapportion the subdistricts districts to reflect the results

1of the census. A nominating petition for a candidate for
2commissioner from a subdistrict shall contain signatures of
3registered voters from that subdistrict and the requisite
4number of signatures shall be determined from the number of
5ballots cast in the subdistrict in the prior election for
6commissioner of the subdistrict. The requisite number of
7registered voter signatures on a nominating petition for a
8candidate for the at-large commissioner position may come from
9registered voters of any combination of subdistricts and shall
10be based on the number of ballots that were cast in the
11subdistrict in which the greatest number of ballots were cast
12in the prior election for commissioner of that subdistrict.
13    The term of office for the commissioners elected under this
14Section shall commence on the first Monday of the month
15following the month of election. The terms of all appointed
16trustees serving on July 16, 2014 (the effective date of Public
17Act 98-772) this amendatory Act of the 98th General Assembly
18shall end when their successors have been elected and
19qualified.
20    (d) The Fox Valley Park District board of commissioners
21shall elect officers of the board at the first meeting of the
22board following the next consolidated election for park
23district commissioners.
24    (e) As of July 16, 2014 (the effective date of Public Act
2598-772) this amendatory Act of the 98th General Assembly, each
26Fox Valley Pleasure Driveway and Park District trustee in

1office shall, as a member of the board of the Fox Valley Park
2District, perform the duties and exercise the powers conferred
3upon park board commissioners under this Code, until his or her
4successor is elected and has qualified.
5    (f) Any tax authorized by referendum or other means under
6this Code and levied by the Fox Valley Pleasure Driveway and
7Park District before July 16, 2014 (the effective date of
8Public Act 98-772) this amendatory Act of the 98th General
9Assembly shall not be affected or abrogated because of the name
10change, and the Fox Valley Park District may continue to levy
11and collect that tax.
