Amends the DUI Prevention and Education Commission Act. Provides that on the first day of each month, the State Treasurer and State Comptroller shall transfer $20,000 from the Roadside Memorial Fund to the DUI Prevention and Education Fund, in addition to the State Comptroller directing and the State Treasurer transferring, on or before June 30 of each year, any remaining balance in excess of $30,000 from the Roadside Memorial Fund to the DUI Prevention and Education Fund.

| 2 | | Be it enacted by the People of the State of Illinois,

| 3 | | represented in the General Assembly:

| 4 | | Section 5. The DUI Prevention and Education Commission Act |
| 5 | | is amended by changing Section 20 as follows:
|
| 6 | | (625 ILCS 70/20)
|
| 7 | | Sec. 20. DUI Prevention and Education Fund; transfer of |
| 8 | | funds. |
| 9 | | (a) The DUI Prevention and Education Fund is created as a |
| 10 | | special fund in the State treasury. Subject to appropriation, |
| 11 | | all moneys in the DUI Prevention and Education Fund shall be |
| 12 | | distributed by the Department of Transportation with guidance |
| 13 | | from the DUI Prevention and Education Commission as grants for |
| 14 | | crash victim programs and materials, impaired driving |
| 15 | | prevention programs, law enforcement support, and other |
| 16 | | DUI-related programs. |
| 17 | | (b) On the first day of each month, or as soon thereafter |
| 18 | | as may be practical, the State Treasurer and State Comptroller |
| 19 | | shall transfer $20,000 from the Roadside Memorial Fund to the |
| 20 | | DUI Prevention and Education Fund, except that, |
| 21 | | notwithstanding any other provision of law, and in addition to |
| 22 | | any other transfers that may be provided for by law, on or |
| 23 | | before June 30 of each year As soon as practical after the |
