1 | AN ACT concerning transportation.

2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
3 | represented in the General Assembly:
| |||||||||||||||||||
4 | Section 5. The Illinois Vehicle Code is amended by changing | |||||||||||||||||||
5 | Section 11-1414.1 as follows:
| |||||||||||||||||||
6 | (625 ILCS 5/11-1414.1) (from Ch. 95 1/2, par. 11-1414.1)
| |||||||||||||||||||
7 | Sec. 11-1414.1. School transportation of students.
| |||||||||||||||||||
8 | (a) Every student enrolled in grade 12 or below in any | |||||||||||||||||||
9 | entity listed in subsection (a) of Section 1-182 of this Code | |||||||||||||||||||
10 | must be transported in a school bus or a vehicle described in | |||||||||||||||||||
11 | subdivision (1) or (2) of subsection (b) of Section 1-182 of | |||||||||||||||||||
12 | this Code for any curriculum-related school activity, except : | |||||||||||||||||||
13 | (1) a student in any of grades 9 through 12 or a | |||||||||||||||||||
14 | student in any of grades K through 12 with an | |||||||||||||||||||
15 | Individualized Education Plan (IEP) with a staff to student | |||||||||||||||||||
16 | ratio of 1 to 5, and attending Acacia Academy, Alexander | |||||||||||||||||||
17 | Leigh, Marklund, Helping Hands Center, Connections | |||||||||||||||||||
18 | Organization, Soaring Eagle Academy, or New Horizon | |||||||||||||||||||
19 | Academy ; or | |||||||||||||||||||
20 | (2) a student in any of grades 9 through 12 who | |||||||||||||||||||
21 | participate in a career exploration program, as approved by | |||||||||||||||||||
22 | a parent or guardian; | |||||||||||||||||||
23 | may be transported in a multifunction multi-function school |

1 | activity bus (MFSAB) as defined in Section 1-148.3a-5 of this | ||||||
2 | Code for any curriculum-related activity except for | ||||||
3 | transportation on regular bus routes from home to school or | ||||||
4 | from school to home, subject to the following conditions: | ||||||
5 | (i) A MFSAB may not be used to transport students under | ||||||
6 | this Section unless the driver holds a valid school bus | ||||||
7 | driver permit. | ||||||
8 | (ii) The use of a MFSAB under this Section is subject | ||||||
9 | to the requirements of Sections 6-106.11, 6-106.12, | ||||||
10 | 12-707.01, 13-101, and 13-109 of this Code. | ||||||
11 | "Curriculum-related school activity" as used in this | ||||||
12 | subsection (a) includes transportation from home to school or | ||||||
13 | from school to home, tripper or shuttle service between school | ||||||
14 | attendance centers, transportation to a vocational or career | ||||||
15 | center or other trade-skill development site or a regional safe | ||||||
16 | school or other school-sponsored alternative learning program, | ||||||
17 | or a trip that is directly related to the regular curriculum of | ||||||
18 | a student for which he or she earns credit.

19 | (b) Every student enrolled in grade 12 or below in any | ||||||
20 | entity listed in subsection (a) of Section 1-182 of this Code | ||||||
21 | who is transported in a vehicle that is being operated by or | ||||||
22 | for a public or private primary or secondary school, including | ||||||
23 | any primary or secondary school operated by a religious | ||||||
24 | institution, for an interscholastic, interscholastic-athletic, | ||||||
25 | or school-sponsored, noncurriculum-related activity that (i) | ||||||
26 | does not require student participation as part of the |

1 | educational services of the entity and (ii) is not associated | ||||||
2 | with the students' regular class-for-credit schedule shall | ||||||
3 | transport students only in a school bus or vehicle described in | ||||||
4 | subsection (b) of Section 1-182 of this Code. This subsection | ||||||
5 | (b) does not apply to any second division vehicle used by an | ||||||
6 | entity listed in subsection (a) of Section 1-182 of this Code | ||||||
7 | for a parade, homecoming, or a similar noncurriculum-related | ||||||
8 | school activity.
