2 | WHEREAS, On March 9, 2020, acting under Section 7 of the | ||||||
3 | Illinois Emergency Management Agency Act, the Governor found | ||||||
4 | that a disaster existed within the State of Illinois due to the | ||||||
5 | public health emergency caused by the outbreak of Coronavirus | ||||||
6 | Disease 2019 (COVID-19) and specifically declared all counties | ||||||
7 | in the State of Illinois as a disaster area; and
| ||||||
8 | WHEREAS, The Statewide public health emergency caused by | ||||||
9 | the outbreak of COVID-19 continues to this day, and the ongoing | ||||||
10 | danger presented by the virus requires the use of extraordinary | ||||||
11 | precautions to reduce the risk of infection while allowing the | ||||||
12 | Senate to complete the business of the People of the State of | ||||||
13 | Illinois in its spring legislative session; and
| ||||||
14 | WHEREAS, The public may view Senate sessions and committees | ||||||
15 | through electronic means, such as www.ilga.gov, and may submit | ||||||
16 | written testimony through www.ilga.gov; and | ||||||
17 | WHEREAS, While necessary, extraordinary precautions taken | ||||||
18 | to reduce the risk of infection must be done with regard for | ||||||
19 | the rights and requirements set forth in the United States and | ||||||
20 | Illinois Constitutions, together with the need for the orderly | ||||||
21 | conduct of the business of the People of the State of Illinois; | ||||||
22 | therefore, be it

1 | RESOLVED, BY THE SENATE OF THE ONE HUNDRED FIRST GENERAL | ||||||
2 | ASSEMBLY OF THE STATE OF ILLINOIS, that the following Rules are | ||||||
3 | adopted for the conduct of this Special Session:

4 | ARTICLE XIII
| ||||||
5 | SPECIAL SESSION
| ||||||
6 | (Senate Rule 13-1 new)
| ||||||
7 | 13-1. Applicability and construction. The meetings and | ||||||
8 | actions of the Senate, including
all of its committees, in this | ||||||
9 | special session shall be governed by the Senate Rules adopted | ||||||
10 | by the regular session of the Senate of the 101st General | ||||||
11 | Assembly, together with the provisions contained in this | ||||||
12 | Article. Where there is a conflict between the Senate Rules | ||||||
13 | adopted by the regular session of the Senate of the 101st | ||||||
14 | General Assembly and the provisions contained in this Article, | ||||||
15 | the provisions contained in this Article shall be controlling.

16 | (Senate Rule 13-2 new)
| ||||||
17 | 13-2. Public access to proceedings. | ||||||
18 | (a) The Presiding Officer shall designate a process for the | ||||||
19 | public to observe the meetings and actions of the Senate, | ||||||
20 | including
all of its committees, via video or other electronic |

1 | means. | ||||||
2 | (b) The Presiding Officer shall designate a process for the | ||||||
3 | committees of the Senate to receive testimony from members of | ||||||
4 | the public via electronic means.

5 | (Senate Rule 13-3 new)
| ||||||
6 | 13-3. Floor debate and personal privilege. | ||||||
7 | (a) Prior to floor debate, the President, in consultation | ||||||
8 | with the Minority Leader, may establish the total number of | ||||||
9 | speakers and number of speakers for each caucus who shall be | ||||||
10 | recognized for debate for any legislative measure. If such a | ||||||
11 | debate protocol is established, then the Presiding Officer | ||||||
12 | shall announce prior to debate: (1) the total number of | ||||||
13 | speakers; (2) number of speakers for each caucus; and (3) the | ||||||
14 | member designated as floor manager by the respective caucus | ||||||
15 | leader to manage the number of speakers for that caucus. | ||||||
16 | (b) Members may not introduce guests or make points of | ||||||
17 | personal privilege during the special session, these shall be | ||||||
18 | reserved for regular session.

19 | (Senate Rule 13-4 new)
| ||||||
20 | 13-4. Verification of attendance. | ||||||
21 | (a) At the beginning of each day of the special session, | ||||||
22 | the President, or his or her designee, and the Minority Leader, | ||||||
23 | or his or her designee, shall provide to the Secretary the | ||||||
24 | names of those members of his or her respective caucus who are |

1 | excused from attendance for that day. All members not so | ||||||
2 | excused shall be counted as present for the purposes of | ||||||
3 | determining a quorum or voting in the Senate or its committees. | ||||||
4 | (b) The name of any member not already excused from | ||||||
5 | attendance for a day of the special session who leaves the | ||||||
6 | State Capitol prior to adjournment of the special session for | ||||||
7 | that day shall be added to names of those members of that | ||||||
8 | caucus who are excused from attendance for that day, and his or | ||||||
9 | her name shall be provided by the President, or his or her | ||||||
10 | designee, or the Minority Leader, or his or her designee, as | ||||||
11 | the case may be, to the Secretary. Once a member's name has | ||||||
12 | been provided to the Secretary under this paragraph, that | ||||||
13 | member shall not be counted as present for the purposes of | ||||||
14 | determining a quorum or voting in the Senate or its committees | ||||||
15 | for the remainder of that day or until that member's presence | ||||||
16 | is reestablished under subsection (c). | ||||||
17 | (c) If a member who has left the State Capitol as described | ||||||
18 | in paragraph (b) returns prior to adjournment of the special | ||||||
19 | session for that day, his or her name shall be provided by the | ||||||
20 | President, or his or her designee, or the Minority Leader, or | ||||||
21 | his or her designee, as the case may be, to the Secretary who | ||||||
22 | shall remove it from the names of those members of that caucus | ||||||
23 | who are excused from attendance for that day. Once a member's | ||||||
24 | name has been provided to the Secretary under this paragraph, | ||||||
25 | that member shall be counted as present for the purposes of | ||||||
26 | determining a quorum or voting in the Senate or its committees. |

1 | (d) If a member who was excused from attendance as | ||||||
2 | described in paragraph (a) thereafter arrives at the State | ||||||
3 | Capitol prior to adjournment of the special session for that | ||||||
4 | day, his or her name shall be provided by the President, or his | ||||||
5 | or her designee, or the Minority Leader, or his or her | ||||||
6 | designee, as the case may be, to the Secretary who shall remove | ||||||
7 | it from the names of those members of that caucus who are | ||||||
8 | excused from attendance for that day. Once a member's name has | ||||||
9 | been provided to the Secretary under this paragraph, that | ||||||
10 | member shall be counted as present for the purposes of | ||||||
11 | determining a quorum or voting in the Senate or its committees. | ||||||
12 | (e) No Senator may request verification of the results of | ||||||
13 | any roll call in the Senate or its committees during the | ||||||
14 | special session.
