SYNOPSIS AS INTRODUCED:
 
730 ILCS 152/115

    Amends the Sex Offender Community Notification Law. Provides that a sex offender's residence and place of employment shall be entered into the Statewide Sex Offender Database. Provides that the Illinois State Police must make the information contained in the Statewide Sex Offender Database searchable via a mapping system which identifies registered sex offenders living or working (rather than just living) within 5 miles of an identified address.

1    AN ACT concerning criminal law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Sex Offender Community Notification Law is
5amended by changing Section 115 as follows:
 
6    (730 ILCS 152/115)
7    Sec. 115. Sex offender database.
8    (a) The Department of State Police shall establish and
9maintain a Statewide Sex Offender Database for the purpose of
10identifying sex offenders and making that information,
11including sex offenders' residences and places of employment,
12available to the persons specified in Sections 120 and 125 of
13this Law. The Database shall be created from the Law
14Enforcement Agencies Data System (LEADS) established under
15Section 6 of the Intergovernmental Missing Child Recovery Act
16of 1984. The Department of State Police shall examine its
17LEADS database for persons registered as sex offenders under
18the Sex Offender Registration Act and shall identify those who
19are sex offenders and shall add all the information, including
20photographs if available, on those sex offenders to the
21Statewide Sex Offender Database.
22    (b) The Department of State Police must make the
23information contained in the Statewide Sex Offender Database

1accessible on the Internet by means of a hyperlink labeled
2"Sex Offender Information" on the Department's World Wide Web
3home page. The Department must make the information contained
4in the Statewide Sex Offender Database searchable via a
5mapping system which identifies registered sex offenders
6living or working within 5 miles of an identified address. The
7Department of State Police must update that information as it
8deems necessary.
9    The Department of State Police may require that a person
10who seeks access to the sex offender information submit
11biographical information about himself or herself before
12permitting access to the sex offender information. The
13Department of State Police must promulgate rules in accordance
14with the Illinois Administrative Procedure Act to implement
15this subsection (b) and those rules must include procedures to
16ensure that the information in the database is accurate.
17    (c) The Department of State Police, Sex Offender
18Registration Unit, must develop and conduct training to
19educate all those entities involved in the Sex Offender
20Registration Program.
