1 | AN ACT concerning education.

2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The School Code is amended by changing Sections | ||||||
5 | 10-20.63 and 34-18.56 as follows: | ||||||
6 | (105 ILCS 5/10-20.63) | ||||||
7 | Sec. 10-20.63. Availability of menstrual feminine hygiene | ||||||
8 | products. | ||||||
9 | (a) The General Assembly finds the following: | ||||||
10 | (1) Menstrual Feminine hygiene products are a health | ||||||
11 | care necessity and not an item that can be foregone or | ||||||
12 | substituted easily. | ||||||
13 | (2) Access to menstrual feminine hygiene products is a | ||||||
14 | serious and ongoing need in this State. | ||||||
15 | (3) When students do not have access to affordable | ||||||
16 | menstrual feminine hygiene products, they may miss | ||||||
17 | multiple days of school every month. | ||||||
18 | (4) When students have access to quality menstrual | ||||||
19 | feminine hygiene products, they are able to continue with | ||||||
20 | their daily lives with minimal interruption. | ||||||
21 | (b) In this Section: | ||||||
22 | "Menstrual hygiene products" "Feminine hygiene products" | ||||||
23 | means tampons and sanitary napkins for use in connection with |

1 | the menstrual cycle. | ||||||
2 | "School building" means any facility (i) that is owned or | ||||||
3 | leased by a school district or over which the school board has | ||||||
4 | care, custody, and control and (ii) in which there is a public | ||||||
5 | school serving students in grades 6 through 12. | ||||||
6 | (c) A school district shall make menstrual feminine | ||||||
7 | hygiene products available, at no cost to students, in | ||||||
8 | bathrooms of every school building that are open for student | ||||||
9 | use in grades 4 through 12 during the regular school day the | ||||||
10 | bathrooms of school buildings .

16 | Section 99. Effective date. This Act takes effect upon | ||||||
17 | becoming law.
