1 | AN ACT concerning health.

2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 1. Short title. This Act may be cited as the Latex | ||||||
5 | Glove Ban Act.
| ||||||
6 | Section 5. Definitions. In this Act: | ||||||
7 | "Department" means the Department of Public Health. | ||||||
8 | "EMS personnel" has the same meaning as provided in | ||||||
9 | Section 3.5 of the Emergency Medical Services (EMS) Systems | ||||||
10 | Act. | ||||||
11 | "Food service establishment" means a food service | ||||||
12 | establishment as that term is used in the Food Handling | ||||||
13 | Regulation Enforcement Act. | ||||||
14 | "Health care facility personnel" means personnel of a | ||||||
15 | health care facility, as that term is defined under Section 3 | ||||||
16 | of the Illinois Health Facilities Planning Act. | ||||||
17 | Section 10. Use of latex gloves prohibited. | ||||||
18 | (a) On and after January 1, 2023, a food service | ||||||
19 | establishment may not permit employees to use latex gloves in | ||||||
20 | the preparation and handling of food. If latex gloves must be | ||||||
21 | used in the preparation of food due to a crisis that interrupts | ||||||
22 | a food service establishment's ability to source nonlatex |

1 | gloves, a sign shall be prominently placed at the point of | ||||||
2 | order or point of purchase clearly notifying the public of the | ||||||
3 | temporary change. To encourage compliance with this | ||||||
4 | subsection, the Department shall send a notice of warning to a | ||||||
5 | food service establishment for its first violation of this | ||||||
6 | subsection. | ||||||
7 | (b) Except as provided under Section 15, on and after | ||||||
8 | January 1, 2023, the use of latex gloves by EMS personnel is | ||||||
9 | prohibited. | ||||||
10 | (c) Except as provided under Section 15, on and after | ||||||
11 | January 1, 2024, the use of latex gloves by health care | ||||||
12 | facility personnel is prohibited if the patient upon whom the | ||||||
13 | latex gloves are to be used is unconscious or otherwise | ||||||
14 | physically unable to communicate and whose medical history | ||||||
15 | lacks sufficient information to indicate whether or not the | ||||||
16 | patient has a latex allergy. | ||||||
17 | Section 15. Exception; crisis situation. Notwithstanding | ||||||
18 | subsections (b) and (c) of Section 10, if a crisis exists that | ||||||
19 | interrupts their ability to reliably source nonlatex gloves, | ||||||
20 | EMS personnel and health care facility personnel may use latex | ||||||
21 | gloves upon a patient. However, during the crisis, EMS | ||||||
22 | personnel and health care facility personnel shall prioritize, | ||||||
23 | to the extent possible, using nonlatex gloves for the | ||||||
24 | treatment of: | ||||||
25 | (1) any patient with a self-identified allergy to |

1 | latex; and | ||||||
2 | (2) any patient upon whom the latex gloves are to be | ||||||
3 | used who is unconscious or otherwise physically unable to | ||||||
4 | communicate and whose medical history lacks sufficient | ||||||
5 | information to indicate whether or not the patient has a | ||||||
6 | latex allergy. |
