1 | | Section 10. Use of latex gloves prohibited. |
2 | | (a) On and after January 1, 2023, a food service |
3 | | establishment may not permit employees to use latex gloves in |
4 | | the preparation and handling of food. If latex gloves must be |
5 | | used in the preparation of food due to a crisis that interrupts |
6 | | a food service establishment's ability to source nonlatex |
7 | | gloves, a sign shall be prominently placed at the point of |
8 | | order or point of purchase clearly notifying the public of the |
9 | | temporary change. To encourage compliance with this |
10 | | subsection, the Department shall send a notice of warning to a |
11 | | food service establishment for its first violation of this |
12 | | subsection. |
13 | | (b) Except as provided under Section 15, on and after |
14 | | January 1, 2023, the use of latex gloves by EMS personnel is |
15 | | prohibited. |
16 | | (c) Except as provided under Section 15, on and after |
17 | | January 1, 2024, the use of latex gloves by health care |
18 | | facility personnel is prohibited if the patient upon whom the |
19 | | latex gloves are to be used is unconscious or otherwise |
20 | | physically unable to communicate and whose medical history |
21 | | lacks sufficient information to indicate whether or not the |
22 | | patient has a latex allergy. |
23 | | Section 15. Exception; crisis situation. Notwithstanding |
24 | | subsections (b) and (c) of Section 10, if a crisis exists that |

1 | | interrupts their ability to reliably source nonlatex gloves, |
2 | | EMS personnel and health care facility personnel may use latex |
3 | | gloves upon a patient. However, during the crisis, EMS |
4 | | personnel and health care facility personnel shall prioritize, |
5 | | to the extent possible, using nonlatex gloves for the |
6 | | treatment of: |
7 | | (1) any patient with a self-identified allergy to |
8 | | latex; and |
9 | | (2) any patient upon whom the latex gloves are to be |
10 | | used who is unconscious or otherwise physically unable to |
11 | | communicate and whose medical history lacks sufficient |
12 | | information to indicate whether or not the patient has a |
13 | | latex allergy.".
