AMENDMENT TO HOUSE BILL 209

2    AMENDMENT NO. ______. Amend House Bill 209 by replacing
3everything after the enacting clause with the following:
 
4    "Section 1. Short title. This Act may be cited as the Latex
5Glove Ban Act.
 
6    Section 5. Definitions. In this Act:
7    "Department" means the Department of Public Health.
8    "EMS personnel" has the same meaning as provided in
9Section 3.5 of the Emergency Medical Services (EMS) Systems
10Act.
11    "Food service establishment" means a food service
12establishment as that term is used in the Food Handling
13Regulation Enforcement Act.
14    "Health care facility personnel" means personnel of a
15health care facility, as that term is defined under Section 3
16of the Illinois Health Facilities Planning Act.

1    Section 10. Use of latex gloves prohibited.
2    (a) On and after January 1, 2023, a food service
3establishment may not permit employees to use latex gloves in
4the preparation and handling of food. If latex gloves must be
5used in the preparation of food due to a crisis that interrupts
6a food service establishment's ability to source nonlatex
7gloves, a sign shall be prominently placed at the point of
8order or point of purchase clearly notifying the public of the
9temporary change. To encourage compliance with this
10subsection, the Department shall send a notice of warning to a
11food service establishment for its first violation of this
12subsection.
13    (b) Except as provided under Section 15, on and after
14January 1, 2023, the use of latex gloves by EMS personnel is
15prohibited.
16    (c) Except as provided under Section 15, on and after
17January 1, 2024, the use of latex gloves by health care
18facility personnel is prohibited if the patient upon whom the
19latex gloves are to be used is unconscious or otherwise
20physically unable to communicate and whose medical history
21lacks sufficient information to indicate whether or not the
22patient has a latex allergy.
 
23    Section 15. Exception; crisis situation. Notwithstanding
24subsections (b) and (c) of Section 10, if a crisis exists that

1interrupts their ability to reliably source nonlatex gloves,
2EMS personnel and health care facility personnel may use latex
3gloves upon a patient. However, during the crisis, EMS
4personnel and health care facility personnel shall prioritize,
5to the extent possible, using nonlatex gloves for the
6treatment of:
7        (1) any patient with a self-identified allergy to
8    latex; and
9        (2) any patient upon whom the latex gloves are to be
10    used who is unconscious or otherwise physically unable to
11    communicate and whose medical history lacks sufficient
12    information to indicate whether or not the patient has a
13    latex allergy.".
