SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Local Government Business Anti-Poaching Act. Provides that no municipality or county shall offer any incentive after the effective date of the Act to a business or corporation to move its headquarters located in Illinois, or any part of its business located in Illinois, away from the current location at the time of the offering of the incentive. Defines "incentive". Limits home rule powers. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the Local
5Government Business Anti-Poaching Act.
 
6    Section 5. Definition. As used in this Act, "incentive"
7means any economic, financial benefit, or other incentive,
8including, but not limited to, those authorized under the
9Economic Development for a Growing Economy Tax Credit Act, the
10Property Tax Code, the Counties Code, the Illinois Municipal
11Code (including, but not limited to, the Tax Increment
12Allocation Redevelopment Act), or any other provision of law
13authorizing abatements, credits, or tax or fee reductions.
 
14    Section 10. Illinois business poaching prohibited.
15Notwithstanding any other provision of law, no municipality or
16county shall offer any incentive after the effective date of
17this Act to a business or corporation to move its headquarters
18located in Illinois, or any part of its business located in
19Illinois, away from the current location at the time of the
20offering of the incentive.
 
21    Section 15. Home rule. The regulation of offering

1incentives for a business or corporation to move its
2headquarters located in Illinois, or any part of its business
3located in Illinois, away from the current location are
4exclusive powers and functions of the State. A home rule unit
5may not regulate such matters. This Act is a denial and
6limitation of home rule powers and functions under subsection
7(h) of Section 6 of Article VII of the Illinois Constitution.
 
8    Section 99. Effective date. This Act takes effect upon
9becoming law.
