| 2 | | Be it enacted by the People of the State of Illinois, |
| 3 | | represented in the General Assembly:

| 4 | | Section 5. The Mental Health and Developmental |
| 5 | | Disabilities Code is amended by changing Section 2-101 as |
| 6 | | follows:
|

| 8 | | Sec. 2-101.
No recipient of services shall be presumed to |
| 9 | | be a person under a legal disability,
nor shall such person be |
| 10 | | held to be a person under a legal disability except as |
| 11 | | determined by a
court. Such determination shall be separate |
| 12 | | from a judicial proceeding held
to determine whether a person |
| 13 | | is subject to involuntary admission or meets
the
