    Amends the Illinois Department of Transportation Law. Grants the City of North Chicago an exclusive option to acquire specified property from the Department of Transportation for public purposes for a period of 3 years.

1    AN ACT concerning property.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Transportation Law of the
5Civil Administrative Code of Illinois is amended by changing
6Section 2705-565 as follows:
 
7    (20 ILCS 2705/2705-565)
8    Sec. 2705-565. North Chicago property; study; conveyance.
9    (a) The Department shall perform a study of property owned
10by the Department consisting of approximately 160 acres
11located in North Chicago, south of IL Route 137, between IL
12Route 43 and US Route 41. The study shall include, but not be
13limited to, a survey of the property for the purpose of
14delineating jurisdictional wetlands in accordance with the
15Interagency Wetland Policy Act of 1989 and identifying
16threatened and endangered species in accordance with the
17Illinois Endangered Species Protection Act, for the purpose of
18identifying property no longer needed for highway purposes.
19    (b) The Upon completion of the study and for a period
20ending 3 years after the effective date of this amendatory Act
21of the 94th General Assembly, the City of North Chicago shall
22have an exclusive option to purchase for public purposes those
2310acres portions of the property no longer needed for highway

1purposes, specifically the property south of IL Route 137,
2between IL Route 43 and US Route 41. for a consideration, which
3may be de minimis, negotiated by the parties. The Department
4of Transportation is authorized to convey the excess property
5to the City of North Chicago pursuant to this Section within 3
6years after the effective date of this amendatory Act of the
7102nd 94th General Assembly, but may not otherwise convey or
8transfer the property during that period.
9    (c) Any conveyance to the City of North Chicago under this
10Section shall provide (i) that title to the property reverts
11to the State of Illinois if the property ceases to be used for
12public purposes and (ii) the City of North Chicago may lease
13the property but may not convey its ownership of the property
14to any party, other than the State of Illinois.
