SYNOPSIS AS INTRODUCED:
 
65 ILCS 5/8-1-2.7 new

    Amends the Illinois Municipal Code. Provides that public funds may not be expended by a non-home rule municipality for registration fees to attend or participate in a convention or gathering of municipal personnel. Provides that a State agency may not expend public funds for expenses connected with the renting or procurement of hospitality suites or other fully-enclosed physical spaces at a convention or gathering of municipal personnel. Provides that a "convention or gathering of municipal personnel" means a gathering of employees or contractors from 2 or more separately domiciled or geographically separated municipalities in a gathering that is sponsored or co-sponsored by a league or association that includes 2 or more municipalities. Provides that the restrictions do not apply to public funds expended at a convention or gathering of public safety personnel, at a convention or gathering of non-home rule municipal personnel relating to economic development and tourism promotion, pursuant to a contract entered into before the effective date of the amendatory Act, or funds appropriated and expended by a non-home rule municipality if specified procedures are followed. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Municipal Code is amended by
5adding Section 8-1-2.7 as follows:
 
6    (65 ILCS 5/8-1-2.7 new)
7    Sec. 8-1-2.7. Conventions and gathering of municipal
8personnel.
9    (a) As used in this Section:
10    "Convention or gathering of municipal personnel" means a
11gathering of employees or contractors from 2 or more
12separately domiciled or geographically separated
13municipalities in a gathering that is sponsored or
14co-sponsored by a league or association that includes 2 or
15more municipalities.
16    "Public safety personnel" has the meaning given to that
17term in subsection (m-5) of Section 1 of the Solicitation for
18Charity Act.
19    "State agency" has the meaning provided in Section 1-7 of
20the Illinois State Auditing Act.
21    (b) Public funds may not be expended by a non-home rule
22municipality for registration fees to attend or participate in
23a convention or gathering of municipal personnel.

1    (c) A State agency may not expend public funds for
2expenses connected with the renting or procurement of
3hospitality suites or other fully-enclosed physical spaces at
4a convention or gathering of municipal personnel.
5    (d) This Section does not apply to public funds expended:
6(1) at a convention or gathering of public safety personnel;
7(2) at a convention or gathering of non-home rule municipal
8personnel relating to economic development and tourism
9promotion; or (3) pursuant to a contract entered into before
10the effective date of this amendatory Act of the 102nd General
11Assembly.
12    (e) This Section does not apply to public funds
13appropriated and expended by a non-home rule municipality if:
14        (1) the appropriation is contained within a line item
15    dedicated solely to convention expenses that includes the
16    name and job title of each employee or contractor who may
17    be reimbursed;
18        (2) notice of the appropriation is posted on the
19    municipality's website not less than 30 days prior to the
20    meeting in which the appropriation will come up for a
21    vote, and the notice must include a statement that the
22    proposed appropriation will use taxpayer funds to allow
23    one or more of the municipality's employees or contractors
24    to travel to a convention; and
25        (3) the appropriation is approved by a majority vote
26    of the governing body of the municipality.

1    Section 99. Effective date. This Act takes effect upon
2becoming law.
