SYNOPSIS AS INTRODUCED:
 
65 ILCS 5/11-74-2  from Ch. 24, par. 11-74-2

    Amends the Industrial Project Revenue Bond Act in the Illinois Municipal Code. In the definition of "industrial project", includes use or disposal of surplus real estate owned by the municipality. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Municipal Code is amended by
5changing Section 11-74-2 as follows:
 
6    (65 ILCS 5/11-74-2)  (from Ch. 24, par. 11-74-2)
7    Sec. 11-74-2. Whenever used in this Division 74, unless a
8different meaning clearly appears from the context:
9    (1) "Industrial project" means any: (a) capital project,
10including one or more buildings and other structures,
11improvements, machinery and equipment whether or not on the
12same site or sites now existing or hereafter acquired,
13suitable for use by any manufacturing, industrial, research,
14transportation or commercial enterprise, including but not
15limited to use as a factory, mill, processing plant, assembly
16plant, packaging plant, fabricating plant, office building,
17industrial distribution center, warehouse, repair, overhaul or
18service facility, freight terminal, research facility, test
19facility, railroad facility, or commercial facility, and
20including also the sites thereof and other rights in land
21therefor whether improved or unimproved, site preparation and
22landscaping, and all appurtenances and facilities incidental
23thereto such as utilities, access roads, railroad sidings,

1truck docking and similar facilities, parking facilities,
2dockage, wharfage, and other improvements necessary or
3convenient thereto; or (b) land, buildings, machinery or
4equipment comprising an addition to or renovation,
5rehabilitation or improvement of any existing capital project;
6(c) construction, remodeling or conversion of a structure to
7be leased to the Illinois Department of Corrections for the
8purposes of its serving as a correctional institution or
9facility pursuant to paragraph (c) of Section 3-2-2 of the
10Unified Code of Corrections; or (d) construction, remodeling
11or conversion of a structure to be leased to the Department of
12Central Management Services for the purpose of serving as a
13State facility pursuant to Section 405-320 of the Department
14of Central Management Services Law; or (e) use or disposal of
15surplus real estate owned by the municipality (20 ILCS
16405/405-320).
17    (2) "Municipality" includes any city, village or
18incorporated town in this State.

20    Section 99. Effective date. This Act takes effect upon
21becoming law.
