AMENDMENT TO HOUSE BILL 2377

2    AMENDMENT NO. ______. Amend House Bill 2377 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Firearm Owners Identification Card Act is
5amended by changing Sections 5 and 7 as follows:
 
6    (430 ILCS 65/5)  (from Ch. 38, par. 83-5)
7    Sec. 5. Application and renewal.
8    (a) The Department of State Police shall either approve or
9deny all applications within 30 days from the date they are
10received, except as provided in subsection (b) of this
11Section, and every applicant found qualified under Section 8
12of this Act by the Department shall be entitled to a Firearm
13Owner's Identification Card upon the payment of a $10 fee. Any
14applicant who is an active duty member of the Armed Forces of
15the United States, a member of the Illinois National Guard, or
16a member of the Reserve Forces of the United States is exempt

1from the application fee. $6 of each fee derived from the
2issuance of Firearm Owner's Identification Cards, or renewals
3thereof, shall be deposited in the Wildlife and Fish Fund in
4the State Treasury; $1 of the fee shall be deposited in the
5State Police Services Fund and $3 of the fee shall be deposited
6in the State Police Firearm Services Fund.
7    (b) Renewal applications shall be approved or denied
8within 60 business days, provided the applicant submitted his
9or her renewal application prior to the expiration of his or
10her Firearm Owner's Identification Card. If a renewal
11application has been submitted prior to the expiration date of
12the applicant's Firearm Owner's Identification Card, the
13Firearm Owner's Identification Card shall remain valid while
14the Department processes the application, unless the person is
15subject to or becomes subject to revocation under this Act.
16The cost for a renewal application shall be $10 which shall be
17deposited into the State Police Firearm Services Fund. The
18Illinois State Police shall notify a person who possesses a
19valid Firearm Owner's Identification Card of the expiration of
20his or her Card at least 90 days before its expiration. The
21Illinois State Police shall establish and maintain an email
22and text message notification system for persons who are
23applying for or possess a Firearm Owner's Identification Card.
24In addition to receiving a mail notification of the status of a
25person's application for, renewal, suspension, or revocation
26of his or her Firearm Owner's Identification Card, the person

1may request email or text message, or both, notifications of
2the status of his or her application, renewal, suspension,
3revocation, and other notifications concerning his or her
4Firearm Owner's Identification Card.

7    Sec. 7. Validity of Firearm Owner's Identification Card.
8    (a) Except as provided in Section 8 of this Act or
9subsection (b) of this Section, a Firearm Owner's
10Identification Card issued under the provisions of this Act
11shall be valid for the person to whom it is issued for a period
12of 10 years from the date of issuance, except that if a person
13is issued a concealed carry license under the Firearm
14Concealed Carry Act, the person may be issued a Firearm
15Owner's Identification Card that is valid for the person to
16whom it is issued for a period of 5 years and expires upon the
17expiration of the person's concealed carry license.
18    (b) If a renewal application is submitted to the
19Department before the expiration date of the applicant's
20current Firearm Owner's Identification Card, the Firearm
21Owner's Identification Card shall remain valid for a period of
2260 business days, unless the person is subject to or becomes
23subject to revocation under this Act.

1    Section 10. The Firearm Concealed Carry Act is amended by
2changing Section 50 and by adding Section 50.1 as follows:
 
3    (430 ILCS 66/50)
4    Sec. 50. License renewal.
5    (a) This subsection (a) applies through the 180th day
6following the effective date of this amendatory Act of the
7101st General Assembly. Applications for renewal of a license
8shall be made to the Department. A license shall be renewed for
9a period of 5 years upon receipt of a completed renewal
10application, completion of 3 hours of training required under
11Section 75 of this Act, payment of the applicable renewal fee,
12and completion of an investigation under Section 35 of this
13Act. The renewal application shall contain the information
14required in Section 30 of this Act, except that the applicant
15need not resubmit a full set of fingerprints.
16    (b) This subsection (b) applies on and after the 181st day
17following the effective date of this amendatory Act of the
18101st General Assembly. Applications for renewal of a license
19shall be made to the Department. A license shall be renewed for
20a period of 5 years from the date of expiration on the
21applicant's current license upon the receipt of a completed
22renewal application, completion of 3 hours of training
23required under Section 75 of this Act, payment of the
24applicable renewal fee, and completion of an investigation
25under Section 35 of this Act. The renewal application shall

1contain the information required in Section 30 of this Act,
2except that the applicant need not resubmit a full set of
3fingerprints.
4    (c) The Illinois State Police shall notify a person who
5possesses a valid concealed carry license of the expiration of
6his or her license at least 90 days before its expiration.

9    Sec. 50.1. Email and text message notifications. The
10Illinois State Police shall establish and maintain an email
11and text message notification system for persons who are
12applying for or possess concealed carry licenses. In addition
13to receiving a mail notification of the status of a person's
14application for, renewal, suspension, or revocation of his or
15her concealed carry license, the person may request email or
16text message, or both, notifications of the status of his or
17her application, renewal, suspension, revocation, and other
18notifications concerning his or her concealed carry license.".
