SYNOPSIS AS INTRODUCED:
 
510 ILCS 70/7.1  from Ch. 8, par. 707.1

    Amends the Humane Care for Animals Act. Adds firefighter and paramedic to the list of persons who are authorized, after making a reasonable effort to locate the owner or person responsible for a companion animal, to enter a motor vehicle by any reasonable means if he or she has probable cause to believe that the animal's health or safety is at risk.

1    AN ACT concerning animals.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Humane Care for Animals Act is amended by
5changing Section 7.1 as follows:
 
6    (510 ILCS 70/7.1)  (from Ch. 8, par. 707.1)
7    Sec. 7.1. Confinement in motor vehicle. No owner or
8person shall confine any companion animal in a motor vehicle
9in such a manner that places it in a life or health threatening
10situation by exposure to a prolonged period of extreme heat or
11cold, without proper ventilation or other protection from such
12heat or cold. In order to protect the health and safety of a
13companion an animal, an animal control officer, firefighter,
14paramedic, law enforcement officer, or Department investigator
15who has probable cause to believe that this Section is being
16violated shall have authority to enter such motor vehicle by
17any reasonable means under the circumstances after making a
18reasonable effort to locate the owner or other person
19responsible.
20    A person convicted of violating this Section is guilty of
21a Class C misdemeanor. A second or subsequent violation is a
22Class B misdemeanor.
