SYNOPSIS AS INTRODUCED:
 
425 ILCS 30/5 new

    Amends the Fireworks Regulation Act of Illinois. Provides that the storage, possession, sale, and use of nonfireworks shall be permitted at all times throughout the State. Requires regulation of nonfireworks, including their storage and sale, to be consistent with the standards set forth in the National Fire Protection Association's Code for the Manufacture, Transportation, Storage and Retail Sales of Fireworks and Pyrotechnic Articles, 2006 edition. Provides that the amendatory provisions do not apply to the City of Chicago. Defines "nonfireworks".

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Fireworks Regulation Act of Illinois is
5amended by adding Section 5 as follows:
 
6    (425 ILCS 30/5 new)
7    Sec. 5. Storage, possession, sale, and use of
8nonfireworks.
9    (a) The storage, possession, sale, and use of nonfireworks
10shall be permitted at all times throughout the State.
11    (b) The regulation of nonfireworks, including their
12storage and sale, shall be consistent with the standards set
13forth in the National Fire Protection Association's Code for
14the Manufacture, Transportation, Storage and Retail Sales of
15Fireworks and Pyrotechnic Articles (NFPA 1124), 2006 edition.
16    (c) Subsections (a) and (b) do not apply to the City of
17Chicago.
18    (d) In this Section, "nonfirework" means:
19        (1) toy pistols that use caps containing fewer than
20    20/100 grains of explosive mixture;
21        (2) toy guns that use paper caps containing 25/100
22    grains or fewer of explosive compound;
23        (3) wood stick or wire sparklers containing not more

1    than I00 grams of pyrotechnic mixture per item;
2        (4) handheld or ground based sparkling devices that
3    are nonexplosive and nonaerial, sometimes producing a
4    crackling or whistling effect, and containing 75 grams or
5    fewer of pyrotechnic composition per tube or a total of
6    500 grams or fewer for multiple tubes;
7        (5) snakes and glow worms;
8        (6) smoke devices; and
9        (7) trick noisemakers, including, but not limited to,
10    party poppers, snappers, and drop pops, each containing
11    25/100 grains or fewer of explosive mixture.
