1 | AMENDMENT TO HOUSE BILL 3190

2 | AMENDMENT NO. ______. Amend House Bill 3190 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "Section 5. The Environmental Protection Act is amended by | ||||||
5 | adding Section 9.18 as follows: | ||||||
6 | (415 ILCS 5/9.18 new) | ||||||
7 | Sec. 9.18. Perfluoroalkyl and polyfluoroalkyl substances. | ||||||
8 | (a) In this Section: | ||||||
9 | "Incineration" includes, but is not limited to, burning, | ||||||
10 | combustion, pyrolysis, gasification, thermal oxidation | ||||||
11 | (including flameless and regenerative), acid recovery furnace | ||||||
12 | or oxidizer, ore roaster, cement kiln, lightweight aggregate | ||||||
13 | kiln, industrial furnace, boiler, and process heater. | ||||||
14 | "Perfluoroalkyl and polyfluoroalkyl substances" means a | ||||||
15 | class of fluorinated organic chemicals containing at least one | ||||||
16 | fully fluorinated carbon atom. |

1 | (b) The disposal by incineration of aqueous film-forming | ||||||
2 | foam that contains perfluoroalkyl and polyfluoroalkyl | ||||||
3 | substances is prohibited in an area of environmental justice | ||||||
4 | concern. | ||||||
5 | (c) The Agency may adopt rules it deems necessary to carry | ||||||
6 | out the provisions of this Section.

7 | Section 99. Effective date. This Act takes effect upon | ||||||
8 | becoming law.".
