Amends the Criminal Code of 2012. Provides that any person who, prior to the effective date of the amendatory Act, lawfully possessed an assault weapon shall register the assault weapon with the Illinois State Police within 90 days after the effective date of the amendatory Act and any person who acquired an assault weapon on or after the effective date of the amendatory Act shall register the assault weapon with the Illinois State Police within 90 days after he or she purchased or was given the weapon. Provides that the registration shall contain a description of the assault weapon that identifies it uniquely, including all identification marks, the full name, address, date of birth, and thumbprint of the owner, and any other information that the Director of the Illinois State Police deems appropriate. Provides that the Illinois State Police may charge a fee for registration not to exceed the reasonable processing costs of the Illinois State Police. Provides that the fees shall be deposited into the State Police Firearm Services Fund. Provides that a violation of these provisions is a Class A misdemeanor. Defines various terms.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The Criminal Code of 2012 is amended by adding |
5 | | Section 24-1.9 as follows: |
6 | | (720 ILCS 5/24-1.9 new) |
7 | | Sec. 24-1.9. Firearms; assault weapons. |
8 | | (a) In this Section: |
9 | | "Assault weapon" means: |
10 | | (1)
a semiautomatic rifle that has the capacity to accept |
11 | | a large capacity magazine detachable or otherwise and one or |
12 | | more of the following: |
13 | | (A)
only a pistol grip without a stock attached; |
14 | | (B)
any feature capable of functioning as a protruding |
15 | | grip that can be held by the non-trigger hand; |
16 | | (C)
a folding, telescoping or thumbhole stock; |
17 | | (D)
a shroud attached to the barrel, or that partially |
18 | | or completely encircles the barrel, allowing the bearer to |
19 | | hold the firearm with the non-trigger hand without being |
20 | | burned, but excluding a slide that encloses the barrel; or |
21 | | (E)
a muzzle brake or muzzle compensator; |
22 | | (2)
a semiautomatic pistol or any semi-automatic rifle |
23 | | that has a fixed magazine, that has the capacity to accept more |

a semiautomatic pistol that has the capacity to accept |
3 | | a detachable magazine and has one or more of the following: |

6 | | (B)
a folding, telescoping or thumbhole stock; |
7 | | (C)
a shroud attached to the barrel, or that partially |
8 | | or completely encircles the barrel, allowing the bearer to |
9 | | hold the firearm with the non-trigger hand without being |
10 | | burned, but excluding a slide that encloses the barrel; |
11 | | (D)
a muzzle brake or muzzle compensator; or |
12 | | (E)
the capacity to accept a detachable magazine at |
13 | | some location outside of the pistol grip; |
14 | | (4)
a semiautomatic shotgun that has one or more of the |
15 | | following: |
16 | | (A)
only a pistol grip without a stock attached; |
17 | | (B)
any feature capable of functioning as a protruding |
18 | | grip that can be held by the non-trigger hand; |
19 | | (C)
a folding, telescoping or thumbhole stock; |
20 | | (D)
a fixed magazine capacity in excess of five |
21 | | rounds; |
22 | | (E)
an ability to accept a detachable magazine; or |
23 | | (F)
a grenade, flare or rocket launcher; |
24 | | (5)
any shotgun with a revolving cylinder; |
25 | | (6)
a conversion kit, part or combination of parts, from |
26 | | which an assault weapon can be assembled if those parts are in |

7 | | "Assault weapon" does not include any firearm that has |
8 | | been made permanently inoperable, or satisfies the definition |
9 | | of "antique firearm", so that the shroud protects the user of |
10 | | the firearm from heat generated by the barrel. The term does |
11 | | not include: |
12 | | (i) a slide that partially or completely encloses |
13 | | the barrel; or |
14 | | (ii) an extension of the stock along the bottom of |
15 | | the barrel which does not completely or substantially |
16 | | encircle the barrel. |
17 | | "Detachable magazine" means any ammunition feeding device, |
18 | | the function of which is to deliver one or more ammunition |
19 | | cartridges into the firing chamber, which can be removed from |
20 | | the firearm without the use of any tool, including a bullet or |
21 | | ammunition cartridge.
Large-capacity magazine means any |
22 | | ammunition feeding device with the capacity to accept more |
23 | | than 10 rounds, but shall not be construed to include the |
24 | | following: |
25 | | (1)
a feeding device that has been permanently altered |
26 | | so that it cannot accommodate more than ten rounds; |

1 | | (2)
a 22-caliber tube ammunition feeding device; or |
2 | | (3)
a tubular magazine that is contained in a |
3 | | lever-action firearm. |
4 | | "Muzzle brake" means a device attached to the muzzle of a |
5 | | weapon that utilizes escaping gas to reduce recoil. |
6 | | "Muzzle compensator" means a device attached to the muzzle |
7 | | of a weapon that utilizes escaping gas to control muzzle |
8 | | movement. |
9 | | "Rocket" means any simple or complex tube-like device |
10 | | containing combustibles that on being ignited liberate gases |
11 | | whose action propels the device through the air and has a |
12 | | propellant charge of not more than 4 ounces. |
13 | | "Grenade", "flare" or "rocket launcher" means an |
14 | | attachment for use on a firearm that is designed to propel a |
15 | | grenade, flare, rocket, or other similar destructive device.

16 | | Belt-fed semiautomatic firearm means any repeating firearm |
17 | | that: |
18 | | (1) utilizes a portion of the energy of a firing |
19 | | cartridge to extract the fired cartridge case and chamber |
20 | | the next round; |
21 | | (2) requires a separate pull of the trigger to fire |
22 | | each cartridge; and |
23 | | (3) has the capacity to accept a belt ammunition |
24 | | feeding device. |
25 | | (b) Any person who, prior to the effective date of this |
26 | | amendatory Act of the 102nd General Assembly, lawfully |

1 | | possessed an assault weapon shall register the firearm with |
2 | | the Illinois State Police within 90 days after the effective |
3 | | date of this amendatory Act of the 102nd General Assembly and |
4 | | any person who acquired an assault weapon on or after the |
5 | | effective date of this amendatory Act of the 102nd General |
6 | | Assembly shall register the assault weapon with the Illinois |
7 | | State Police within 90 days after he or she purchased or was |
8 | | given the weapon. |
9 | | (c) The registration shall contain a description of the |
10 | | assault weapon that identifies it uniquely, including all |
11 | | identification marks, the full name, address, date of birth, |
12 | | and thumbprint of the owner, and any other information that |
13 | | the Director of the Illinois State Police deems appropriate. |
14 | | (d) The Illinois State Police may charge a fee for |
15 | | registration not to exceed the reasonable processing costs of |
16 | | the Illinois State Police. The fees shall be deposited into |
17 | | the State Police Firearm Services Fund. |
18 | | (e) Registrations shall be submitted electronically via |
19 | | the Internet utilizing a public-facing application made |
20 | | available by the Illinois State Police. |
21 | | (f) The registration shall contain a description of the |
22 | | assault weapon that identifies it uniquely, including all |
23 | | identification marks, the date the assault weapon was |
24 | | acquired, the name and address of the individual from whom, or |
25 | | business from which, the assault weapon was acquired, as well |
26 | | as the registrant's full name, address, telephone number, date |

1 | | of birth, sex, height, weight, eye color, hair color, and |
2 | | Illinois driver's license number or Illinois identification |
3 | | card number. |
4 | | (g) The Director of the Illinois State Police shall adopt |
5 | | rules for the purpose of implementing this Section. |
6 | | (h) Sentence. A violation of this Section is a Class A |
7 | | misdemeanor.
