| 1 | AN ACT concerning education.

| 2 | Be it enacted by the People of the State of Illinois,
| ||||||
| 3 | represented in the General Assembly:
| ||||||
| 4 | Section 5. The University of Illinois Act is amended by | ||||||
| 5 | adding Section 120 as follows: | ||||||
| 6 | (110 ILCS 305/120 new) | ||||||
| 7 | Sec. 120. Personal support worker's attendance in class | ||||||
| 8 | permitted. If a student of the University has a personal | ||||||
| 9 | support worker through the Home-Based Support
Services Program | ||||||
| 10 | for Adults with Mental Disabilities under the
Developmental | ||||||
| 11 | Disability and Mental Disability Services Act, the Board of | ||||||
| 12 | Trustees must permit the personal support worker to attend | ||||||
| 13 | class with the student but is not responsible for providing or | ||||||
| 14 | paying for the personal support worker. If the personal | ||||||
| 15 | support worker's attendance in class is solely to provide | ||||||
| 16 | personal support services to the student, the Board may not | ||||||
| 17 | charge the personal support worker tuition and fees for such | ||||||
| 18 | attendance. | ||||||
| 19 | Section 10. The Southern Illinois University Management | ||||||
| 20 | Act is amended by adding Section 100 as follows: | ||||||
| 21 | (110 ILCS 520/100 new) | ||||||

| 1 | Sec. 100. Personal support worker's attendance in class | ||||||
| 2 | permitted. If a student of the University has a personal | ||||||
| 3 | support worker through the Home-Based Support
Services Program | ||||||
| 4 | for Adults with Mental Disabilities under the
Developmental | ||||||
| 5 | Disability and Mental Disability Services Act, the Board must | ||||||
| 6 | permit the personal support worker to attend class with the | ||||||
| 7 | student but is not responsible for providing or paying for the | ||||||
| 8 | personal support worker. If the personal support worker's | ||||||
| 9 | attendance in class is solely to provide personal support | ||||||
| 10 | services to the student, the Board may not charge the personal | ||||||
| 11 | support worker tuition and fees for such attendance. | ||||||
| 12 | Section 15. The Chicago State University Law is amended by | ||||||
| 13 | adding Section 5-210 as follows: | ||||||
| 14 | (110 ILCS 660/5-210 new) | ||||||
| 15 | Sec. 5-210. Personal support worker's attendance in class | ||||||
| 16 | permitted. If a student of the University has a personal | ||||||
| 17 | support worker through the Home-Based Support
Services Program | ||||||
| 18 | for Adults with Mental Disabilities under the
Developmental | ||||||
| 19 | Disability and Mental Disability Services Act, the Board must | ||||||

| 5 | by adding Section 35-215 as follows: | ||||||

| 7 | Sec. 35-215. Personal support worker's attendance in class | ||||||
| 8 | permitted. If a student of the University has a personal | ||||||
| 9 | support worker through the Home-Based Support
Services Program | ||||||
| 10 | for Adults with Mental Disabilities under the
Developmental | ||||||
| 11 | Disability and Mental Disability Services Act, the Board must | ||||||
| 12 | permit the personal support worker to attend class with the | ||||||
| 13 | student but is not responsible for providing or paying for the | ||||||
| 14 | personal support worker. If the personal support worker's | ||||||
| 15 | attendance in class is solely to provide personal support | ||||||
| 16 | services to the student, the Board may not charge the personal | ||||||
| 17 | support worker tuition and fees for such attendance. | ||||||
| 18 | Section 50. The Public Community College Act is amended by | ||||||
| 19 | adding Section 3-29.14 as follows: | ||||||
| 20 | (110 ILCS 805/3-29.14 new) | ||||||
| 21 | Sec. 3-29.14. Personal support worker's attendance in | ||||||
| 22 | class permitted. If a student of a community college district | ||||||

| |||||||
| 1 | has a personal support worker through the Home-Based Support | ||||||
| 2 | Services Program for Adults with Mental Disabilities under the
| ||||||
| 3 | Developmental Disability and Mental Disability Services Act, | ||||||
| 4 | the board must permit the personal support worker to attend | ||||||
| 5 | class with the student but is not responsible for providing or | ||||||
| 6 | paying for the personal support worker. If the personal | ||||||
| 7 | support worker's attendance in class is solely to provide | ||||||
| 8 | personal support services to the student, the board may not | ||||||
| 9 | charge the personal support worker tuition and fees for such | ||||||
| 10 | attendance.

| 11 | Section 99. Effective date. This Act takes effect upon | ||||||
| 12 | becoming law.
