SYNOPSIS AS INTRODUCED:
 
305 ILCS 5/12-4.54 new

    Amends the Illinois Public Aid Code. Requires the Department of Human Services to contract with a third-party vendor to conduct quarterly checks on the eligibility of persons receiving benefits under the State's Medical Assistance Program or under the federal Supplemental Nutrition Assistance Program (SNAP). Provides that at a minimum, the third-party vendor shall collect documentation of the person's identity, including, but not limited to, a copy of the person's Illinois driver's license, Illinois Identification Card, or any other form of identification as prescribed by the Department by rule. Provides that the third-party vendor shall also collect any other relevant information, as determined by the Department, that could affect a person's eligibility for medical assistance or SNAP benefits. Requires the Department to provide persons subject to the eligibility checks with written notice of the eligibility checks. Requires the Department to apply for any federal waiver or State Plan amendment, if required, to implement the provisions of the amendatory Act. Permits the Department to adopt rules.

1    AN ACT concerning public aid.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Public Aid Code is amended by
5adding Section 12-4.54 as follows:
 
6    (305 ILCS 5/12-4.54 new)
7    Sec. 12-4.54. Quarterly eligibility checks; medical
8assistance; SNAP. Notwithstanding any other law to the
9contrary, the Department of Human Services shall contract with
10a third-party vendor to conduct quarterly checks on the
11eligibility of persons receiving benefits under the medical
12assistance program established under Article V of this Code or
13under the federal Supplemental Nutrition Assistance Program
14(SNAP). At a minimum, the third-party vendor shall collect
15documentation of the person's identity, including, but not
16limited to, a copy of the person's Illinois driver's license,
17Illinois Identification Card, or any other form of
18identification as prescribed by the Department by rule. The
19third-party vendor shall also collect any other relevant
20information, as determined by the Department, that could
21affect a person's eligibility for medical assistance or SNAP
22benefits. Prior to conducting a check of a person's
23eligibility for medical assistance or SNAP benefits, the

1Department shall notify the person in writing that the person
2is obligated to comply with the information and documentation
3request made by the third-party vendor as a condition of the
4person's continued eligibility for medical assistance or SNAP
5benefits. Written notice must be provided no less than 15 days
6prior to the start of each quarterly eligibility check.
7    The Department shall apply for any federal waiver or State
8Plan amendment, if required, to implement the provisions of
9this Section. Implementation shall be contingent on federal
10approval. The Department may adopt any rules necessary to
11implement the provisions of this Section upon the receipt of
12federal approval, if required.
