AMENDMENT TO HOUSE BILL 3461

2    AMENDMENT NO. ______. Amend House Bill 3461 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The School Code is amended by changing Section
510-23.13 as follows:
 
6    (105 ILCS 5/10-23.13)
7    Sec. 10-23.13. Policies addressing sexual abuse.
8    (a) In this Section, "evidence-informed" refers to
9modalities that were created utilizing components of
10evidence-based treatments or curriculums.
11    (b) To adopt and implement, by no later than July 1, 2022,
12a policy addressing sexual abuse of children that shall may
13include an age-appropriate and evidence-informed curriculum
14for students in pre-K through 12th 5th grade;
15evidence-informed training for school personnel on child
16sexual abuse; evidence-informed educational information to

1parents or guardians provided in the school handbook on the
2warning signs of a child being abused, along with any needed
3assistance, referral, or resource information; available
4counseling and resources for students affected by sexual
5abuse; and emotional and educational support for a child of
6abuse to continue to be successful in school. A school
7district shall include in its policy and all training
8materials and instruction a definition of prohibited grooming
9behaviors and boundary violations for school personnel and how
10to report these behaviors.
11    Any policy adopted under this Section shall may address
12without limitation:
13        (1) methods for increasing school personnel teacher,
14    student, and parent awareness of issues regarding sexual
15    abuse of children, including awareness and knowledge of
16    likely warning signs indicating that a child may be a
17    victim of sexual abuse, awareness and knowledge of
18    grooming behaviors and how to report those behaviors,
19    awareness of appropriate relationships between school
20    personnel and students based on State law, and how to
21    prevent child abuse from happening, including, but not
22    limited to methods outlined in State law regarding
23    personal health and safety education for students;
24        (1.5) evidence-informed training for school personnel
25    on preventing, recognizing, reporting, and responding to
26    child sexual abuse and grooming behavior, including when

1    the grooming or abuse is committed by a member of the
2    school community, with a discussion of the criminal
3    statutes addressing sexual conduct between school
4    personnel and students, professional conduct, and
5    reporting requirements, including, but not limited to,
6    training as outlined in Section 10-22.39 and Section 3-11;
7        (2) options actions that a student child who is a
8    victim of sexual abuse has should take to obtain
9    assistance and intervention; and
10        (3) available counseling options for students affected
11    by sexual abuse; .
12        (4) methods for educating school personnel, students,
13    and staff on how to report child abuse to law enforcement
14    authorities and to the Department of Children and Family
15    Services and how to report grooming behaviors, including
16    when the grooming or abuse is committed by a member of the
17    school community; and
18        (5) education and information about children's
19    advocacy centers and sexual assault crisis centers and
20    information about how to access a children's advocacy
21    center or sexual assault crisis center serving the
22    district.
23    (c) A school district must provide training for school
24personnel on child sexual abuse as described in paragraph
25(1.5) of subsection (b) no later than January 31 of each year.
26    (d) This Section may be referred to as Erin's Law.
