1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Pharmacy Practice Act is amended by
5changing Section 10 as follows:
 
6    (225 ILCS 85/10)  (from Ch. 111, par. 4130)
7    (Section scheduled to be repealed on January 1, 2023)
8    Sec. 10. State Board of Pharmacy.
9    (a) There is created in the Department the State Board of
10Pharmacy. It shall consist of 11 9 members, 8 7 of whom shall
11be licensed pharmacists. One of the licensed pharmacists shall
12have a primary site for the practice of pharmacy at an
13inpatient hospital pharmacy. Each of those 8 7 members must be
14a licensed pharmacist in good standing in this State, a
15graduate of an accredited college of pharmacy or hold a
16Bachelor of Science degree in Pharmacy and have at least 5
17years' practical experience in the practice of pharmacy
18subsequent to the date of his licensure as a licensed
19pharmacist in the State of Illinois. There shall be one member
20who is a pharmacy technician. There shall be 2 public members,
21who shall be voting members, who shall not be engaged in any
22way, directly or indirectly, as providers of health care in
23this State or any other state.

1    (b) Each member shall be appointed by the Governor.
2    (c) Members shall be appointed to 5 year terms. The
3Governor shall fill any vacancy for the remainder of the
4unexpired term. Partial terms over 3 years in length shall be
5considered full terms. A member may be reappointed for a
6successive term, but no member shall serve more than 2 full
7terms in his or her lifetime.
8    (d) In making the appointment of members on the Board, the
9Governor shall give due consideration to recommendations by
10the members of the profession of pharmacy and by pharmacy
11organizations therein. The Governor shall notify the pharmacy
12organizations promptly of any vacancy of members on the Board
13and in appointing members shall give consideration to
14individuals engaged in all types and settings of pharmacy
15practice.
16    (e) The Governor may remove any member of the Board for
17misconduct, incapacity, or neglect of duty, and he or she
18shall be the sole judge of the sufficiency of the cause for
19removal.
20    (f) Each member of the Board shall be reimbursed for such
21actual and legitimate expenses as he or she may incur in going
22to and from the place of meeting and remaining there during
23sessions of the Board.
24    (g) The Board shall hold quarterly meetings at such times
25and places and upon notice as the Department may determine and
26as its business may require. A majority of the Board members

1currently appointed shall constitute a quorum. A vacancy in
2the membership of the Board shall not impair the right of a
3quorum to exercise all the rights and perform all the duties of
4the Board.
5    (h) The Board shall exercise the rights, powers and duties
6which have been vested in the Board under this Act, and any
7other duties conferred upon the Board by law.
