    Amends the Military Veterans Assistance Act. Provides that the county board of a county having a population of more than 3,000,000 may, but is not required to, enter into an intergovernmental agreement with and provide funding to the Veterans Assistance Commission of the county.

1    AN ACT concerning veterans.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Military Veterans Assistance Act is amended
5by changing Section 10 as follows:
 
6    (330 ILCS 45/10)  (from Ch. 23, par. 3090)
7    Sec. 10.
8    (a) The executive powers of the commission shall be vested
9in a superintendent elected by the commission from among those
10who served in the armed forces of the United States. The
11superintendent, designated Superintendent of Veterans
12Assistance of the county, shall, under the direction of the
13commission, have charge of and maintain an office in the
14county building or other central location, to be used solely
15by the commission for carrying on its assistance work. The
16county shall provide the office and furnish all necessary
17supplies, including telephone, printing, stationery and
18postage therefor.
19    Except as otherwise provided in this subsection (a), the
20The county board shall, in any county where a Veterans
21Assistance Commission is organized, in addition to sums
22appropriated for assistance and emergency assistance purposes
23under this Act, appropriate such additional sums, upon

1recommendation of the Veterans Assistance Commission and as
2approved by the county board, to properly compensate the
3officers and employees required to administer such assistance.
4Such county board approval shall be based upon recognized and
5established salary guidelines developed by the county and used
6by the county to compensate county employees. If the county
7does not have established employee salary guidelines, the
8county board shall provide funds to the commission to
9compensate the superintendent and his employees in a just
10manner. The county board shall also provide funds to the
11commission to reimburse the superintendent, officers,
12delegates and employees for certain expenses which are
13approved by the commission. The superintendent and other
14employees shall be employees of the Veterans Assistance
15Commission, and no provision in this Section or elsewhere in
16this Act shall be construed to mean that they are employees of
17the county.
18    The county board of a county having a population of more
19than 3,000,000 may, but is not required to, enter into an
20intergovernmental agreement with and provide funding to the
21Veterans Assistance Commission of the county under this
22subsection (a).
23    (b) Superintendents, subject to rules formulated by the
24commission, shall select, as far as possible, secretaries and
25other employees from among honorably discharged military
26veterans as defined in Section 2, or their surviving spouses.

1    Superintendents of all counties subject to this Act, when
2required by the commission, shall give bond in the sum of
3$2,000 for the faithful performance of their duties.
4    All persons elected or selected to fill positions provided
5for in this Section shall be exempt from the operation and
6provisions of any civil service act or laws of this State, and
7the secretary of the commission shall be appointed by the
8superintendent. However, if "The Illinois Public Aid Code", as
9amended, becomes applicable in any county, the Department of
10Human Services may exercise the powers therein designated in
11relation to employees engaged in the administration of
12assistance under this Act.
