1 | AMENDMENT TO HOUSE BILL 3596

2 | AMENDMENT NO. ______. Amend House Bill 3596 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "Section 5. The Illinois Controlled Substances Act is | ||||||
5 | amended by adding Section 311.6 as follows: | ||||||
6 | (720 ILCS 570/311.6 new) | ||||||
7 | Sec. 311.6. Opioid prescriptions. | ||||||
8 | (a) Notwithstanding any other provision of law, a | ||||||
9 | prescription for a substance classified in Schedule II, III, | ||||||
10 | IV, or V must be sent electronically, in accordance with | ||||||
11 | Section 316. Prescriptions sent in accordance with this | ||||||
12 | subsection (a) must be accepted by the dispenser in electronic | ||||||
13 | format. | ||||||
14 | (b) Notwithstanding any other provision of this Section or | ||||||
15 | any other provision of law, a prescriber shall not be required | ||||||
16 | to issue prescriptions electronically if he or she certifies |

1 | to the Department of Financial and Professional Regulation | ||||||
2 | that he or she will not issue more than 25 prescriptions during | ||||||
3 | a 12-month period. Prescriptions in both oral and written form | ||||||
4 | for controlled substances shall be included in determining | ||||||
5 | whether the prescriber will reach the limit of 25 | ||||||
6 | prescriptions. | ||||||
7 | (c) The Department of Financial and Professional | ||||||
8 | Regulation shall adopt rules for the administration of this | ||||||
9 | Section. These rules shall provide for the implementation of | ||||||
10 | any such exemption to the requirements under this Section that | ||||||
11 | the Department of Financial and Professional Regulation may | ||||||
12 | deem appropriate, including the exemption provided for in | ||||||
13 | subsection (b).

14 | Section 99. Effective date. This Act takes effect on | ||||||
15 | January 1, 2023.".
