2 | AMENDMENT NO. ______. Amend House Bill 3699, AS AMENDED, | ||||||
3 | by replacing everything after the enacting clause with the | ||||||
4 | following:
| ||||||
5 | "Section 1. Short title. This Act may be cited as the | ||||||
6 | Intergovernmental Carjacking Enforcement Act. | ||||||
7 | Section 5. Definitions. In this Act: | ||||||
8 | "Carjacking" means vehicular hijacking as defined in | ||||||
9 | Section 18-3 of the Criminal Code of 2012 or aggravated | ||||||
10 | vehicular hijacking as defined in Section 18-4 of the Criminal | ||||||
11 | Code of 2012. | ||||||

"Carjacking enforcement group" or "CEG" means a | ||||||
13 | combination of units of local government established under | ||||||
14 | this Act to enforce vehicular hijacking and aggravated | ||||||
15 | vehicular hijacking offenses under the criminal laws of this | ||||||
16 | State. |

1 | "Director" means the Director of the Illinois State | ||||||
2 | Police. | ||||||
3 | "Unit of local government" has the meaning ascribed to it | ||||||
4 | in Section 1 of Article VII of the Illinois Constitution, and | ||||||
5 | includes both home rule units and units of local government | ||||||
6 | that are not home rule units.

7 | Section 10. Carjacking enforcement group; State grants. A | ||||||
8 | carjacking enforcement group that meets the minimum criteria | ||||||
9 | established in this Section is eligible to receive State | ||||||
10 | grants to help defray the costs of operation. To be eligible, a | ||||||
11 | carjacking enforcement group shall: | ||||||
12 | (1) be established and operated under intergovernmental | ||||||
13 | contracts written and executed in conformity with the | ||||||
14 | Intergovernmental Cooperation Act, and involve 2 or more units | ||||||
15 | of local government; | ||||||
16 | (2) establish a carjacking enforcement group policy board | ||||||
17 | composed of an elected official, or his or her designee, and | ||||||
18 | the chief law enforcement officer, or his or her designee, | ||||||
19 | from each participating unit of local government to oversee | ||||||
20 | the operations of the Group and make such reports to the | ||||||
21 | Illinois State Police as the Illinois State Police may | ||||||
22 | require; | ||||||
23 | (3) designate a single appropriate elected official of a | ||||||
24 | participating unit of local government to act as the financial | ||||||
25 | officer of the carjacking enforcement group for all |

1 | participating units of local government and to receive funds | ||||||
2 | for the operation of the Group; | ||||||
3 | (4) limit its operations to enforcement of Sections 18-3 | ||||||
4 | and 18-4 of the Criminal Code of 2012; | ||||||
5 | (5) cooperate with the Illinois State Police in order to | ||||||
6 | assure compliance with this Act and to enable the Illinois | ||||||
7 | State Police to fulfill its duties under this Act, and supply | ||||||
8 | the Illinois State Police with all information the Illinois | ||||||
9 | State Police deems necessary; and | ||||||
10 | (6) receive funding of at least 50% of the total operating | ||||||
11 | budget of the carjacking enforcement group from the | ||||||
12 | participating units of local government.

13 | Section 15. State grants to carjacking enforcement groups. | ||||||
14 | The Illinois State Police shall monitor the operations of all | ||||||
15 | carjacking enforcement group units and determine their | ||||||
16 | eligibility to receive State grants under this Act. From the | ||||||
17 | money appropriated annually by the General Assembly for this | ||||||
18 | purpose, the Director shall determine and certify to the | ||||||
19 | Comptroller the amount of the grant to be made to each | ||||||
20 | designated CEG financial officer. The amount of the State | ||||||
21 | grant to a CEG under this Act may not exceed 50% of the total | ||||||
22 | operating budget of that CEG.

23 | Section 20. Illinois State Police coordination. The | ||||||
24 | Illinois State Police shall coordinate the operations of all |

1 | CEG units and may adopt such reasonable rules and conduct | ||||||
2 | those investigations the Director deems necessary to carry out | ||||||
3 | its duties under this Act, including the establishment of | ||||||
4 | forms for reporting by each CEG to the Illinois State Police.
| ||||||
5 | Section 25. Director to assign functions and duties. The | ||||||
6 | Director may assign the functions and duties created under | ||||||
7 | this Act to be administered by the Illinois State Police, | ||||||
8 | Division of Criminal Investigation.
| ||||||
9 | Section 30. Annual report to the Governor and General | ||||||
10 | Assembly. The Director shall report annually, no later than | ||||||
11 | February 1, to the Governor and the General Assembly on the | ||||||
12 | operations of the carjacking enforcement groups, including a | ||||||
13 | breakdown of the appropriation for the current fiscal year | ||||||
14 | indicating the amount of the State grant each CEG received or | ||||||
15 | will receive.

16 | Section 99. Effective date. This Act takes effect upon | ||||||
17 | becoming law.".
