AMENDMENT TO HOUSE BILL 3699

2    AMENDMENT NO. ______. Amend House Bill 3699, AS AMENDED,
3by replacing everything after the enacting clause with the
4following:
 
5    "Section 1. Short title. This Act may be cited as the
6Intergovernmental Carjacking Enforcement Act.
 
7    Section 5. Definitions. In this Act:
8    "Carjacking" means vehicular hijacking as defined in
9Section 18-3 of the Criminal Code of 2012 or aggravated
10vehicular hijacking as defined in Section 18-4 of the Criminal
11Code of 2012.
12     "Carjacking enforcement group" or "CEG" means a
13combination of units of local government established under
14this Act to enforce vehicular hijacking and aggravated
15vehicular hijacking offenses under the criminal laws of this
16State.

1    "Director" means the Director of the Illinois State
2Police.
3    "Unit of local government" has the meaning ascribed to it
4in Section 1 of Article VII of the Illinois Constitution, and
5includes both home rule units and units of local government
6that are not home rule units.
 
7    Section 10. Carjacking enforcement group; State grants. A
8carjacking enforcement group that meets the minimum criteria
9established in this Section is eligible to receive State
10grants to help defray the costs of operation. To be eligible, a
11carjacking enforcement group shall:
12    (1) be established and operated under intergovernmental
13contracts written and executed in conformity with the
14Intergovernmental Cooperation Act, and involve 2 or more units
15of local government;
16    (2) establish a carjacking enforcement group policy board
17composed of an elected official, or his or her designee, and
18the chief law enforcement officer, or his or her designee,
19from each participating unit of local government to oversee
20the operations of the Group and make such reports to the
21Illinois State Police as the Illinois State Police may
22require;
23    (3) designate a single appropriate elected official of a
24participating unit of local government to act as the financial
25officer of the carjacking enforcement group for all

1participating units of local government and to receive funds
2for the operation of the Group;
3    (4) limit its operations to enforcement of Sections 18-3
4and 18-4 of the Criminal Code of 2012;
5    (5) cooperate with the Illinois State Police in order to
6assure compliance with this Act and to enable the Illinois
7State Police to fulfill its duties under this Act, and supply
8the Illinois State Police with all information the Illinois
9State Police deems necessary; and
10    (6) receive funding of at least 50% of the total operating
11budget of the carjacking enforcement group from the
12participating units of local government.
 
13    Section 15. State grants to carjacking enforcement groups.
14The Illinois State Police shall monitor the operations of all
15carjacking enforcement group units and determine their
16eligibility to receive State grants under this Act. From the
17money appropriated annually by the General Assembly for this
18purpose, the Director shall determine and certify to the
19Comptroller the amount of the grant to be made to each
20designated CEG financial officer. The amount of the State
21grant to a CEG under this Act may not exceed 50% of the total
22operating budget of that CEG.
 
23    Section 20. Illinois State Police coordination. The
24Illinois State Police shall coordinate the operations of all

1CEG units and may adopt such reasonable rules and conduct
2those investigations the Director deems necessary to carry out
3its duties under this Act, including the establishment of
4forms for reporting by each CEG to the Illinois State Police.
 
5    Section 25. Director to assign functions and duties. The
6Director may assign the functions and duties created under
7this Act to be administered by the Illinois State Police,
8Division of Criminal Investigation.
 
9    Section 30. Annual report to the Governor and General
10Assembly. The Director shall report annually, no later than
11February 1, to the Governor and the General Assembly on the
12operations of the carjacking enforcement groups, including a
13breakdown of the appropriation for the current fiscal year
14indicating the amount of the State grant each CEG received or
15will receive.
 
16    Section 99. Effective date. This Act takes effect upon
17becoming law.".
