SYNOPSIS AS INTRODUCED:
 
765 ILCS 835/14.6 new

    Amends the Cemetery Protection Act. Requires a court order before a cemetery may disinter deceased human remains from a multiple-depth burial plot if the involved decedent is not located within a concrete outer burial container and if the involved decedent was interred 10 or more years ago.

1    AN ACT concerning civil law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Cemetery Protection Act is amended by
5adding Section 14.6 as follows:
 
6    (765 ILCS 835/14.6 new)
7    Sec. 14.6. Disinterment of deceased human remains from
8multiple depth burial plots. To help safeguard against the
9unnecessary disruption of other deceased human remains, and in
10recognition of the difficulty in identifying human remains
11after the decomposition process has progressed over time, a
12court order shall be required before a cemetery may disinter
13deceased human remains from a multiple-depth burial plot if
14the involved decedent is not located within a concrete outer
15burial container and if the involved decedent was interred 10
16or more years ago.
