2 | AMENDMENT NO. ______. Amend House Bill 3920 by replacing | ||||||
3 | line 5 on page 4 through line 20 on page 5 with the following:

4 | "Section 15. The Illinois Public Aid Code is amended by | ||||||
5 | adding Section 3-13.5 as follows: | ||||||
6 | (305 ILCS 5/3-13.5 new) | ||||||
7 | Sec. 3-13.5. Supplemental payments for recipients of | ||||||
8 | Supplemental Security Income and other persons. | ||||||
9 | Notwithstanding any other law to the contrary, any individual | ||||||
10 | who receives federal Supplemental Security Income (SSI) | ||||||
11 | benefits shall automatically qualify to receive monthly | ||||||
12 | supplemental payments from the Department in an amount equal | ||||||
13 | to 1/12 of the applicable annual federal poverty level for the | ||||||
14 | individual's family size minus the amount of the individual's | ||||||
15 | monthly federal SSI benefit. An individual's monthly | ||||||
16 | supplemental payment amount shall be adjusted annually to |

1 | reflect changes in the cost of living and other pertinent | ||||||
2 | factors. The supplemental payments under this Section shall | ||||||
3 | also be available to undocumented residents who: (i) have a | ||||||
4 | disability, with supporting documentation meeting requirements | ||||||
5 | determined by the Department by rule; (ii) have an Individual | ||||||
6 | Taxpayer Identification Number; and (iii) are determined by | ||||||
7 | the Department to meet the eligibility requirements for | ||||||
8 | Supplemental Security Income other than the requirements | ||||||
9 | related to status as a citizen or as an alien determined by the | ||||||
10 | federal government to be eligible. | ||||||
11 | Subject to federal approval, the supplemental payments | ||||||
12 | provided under this Section shall not be considered income for | ||||||
13 | purposes of determining eligibility or the amount of | ||||||
14 | assistance for any public aid benefit provided under State or | ||||||
15 | federal law, including, but not limited to, benefits provided | ||||||
16 | under the Medical Assistance Program established under Article | ||||||
17 | V of this Code, personal care benefits and other services | ||||||
18 | provided under the Community Care Program established under | ||||||
19 | Section 4.02 of the Illinois Act on the Aging, benefits | ||||||
20 | provided under the Supplemental Nutrition Assistance Program, | ||||||
21 | or any housing voucher or rental subsidy provided under the | ||||||
22 | Rental Housing Support Program Act or under a similar locally | ||||||
23 | funded rent subsidy program, or under the Housing Choice | ||||||
24 | Voucher Program under Section 8 of the United States Housing | ||||||
25 | Act of 1937. | ||||||
26 | The Illinois Supplemental Payments for Supplemental |

1 | Security Income Recipients Fund is created as a special fund | ||||||
2 | in the State treasury. The Fund shall consist of the proceeds | ||||||
3 | collected under subsection (d) of Section 3 and subsection (c) | ||||||
4 | of Section 4 of the Illinois Estate and Generation-Skipping
| ||||||
5 | Transfer Tax Act. Moneys in the Fund shall be expended for the | ||||||
6 | supplemental payments provided under this Section and for no | ||||||
7 | other purpose. All interest earned on moneys in the Fund shall | ||||||
8 | be deposited into the Fund. | ||||||
9 | Section 99. Effective date. This Act takes effect upon | ||||||
10 | becoming law, except that Section 15 takes effect one year | ||||||
11 | after this Act becomes law.".
