AMENDMENT TO HOUSE BILL 3920

2    AMENDMENT NO. ______. Amend House Bill 3920 by replacing
3line 5 on page 4 through line 20 on page 5 with the following:
 
4    "Section 15. The Illinois Public Aid Code is amended by
5adding Section 3-13.5 as follows:
 
6    (305 ILCS 5/3-13.5 new)
7    Sec. 3-13.5. Supplemental payments for recipients of
8Supplemental Security Income and other persons.
9Notwithstanding any other law to the contrary, any individual
10who receives federal Supplemental Security Income (SSI)
11benefits shall automatically qualify to receive monthly
12supplemental payments from the Department in an amount equal
13to 1/12 of the applicable annual federal poverty level for the
14individual's family size minus the amount of the individual's
15monthly federal SSI benefit. An individual's monthly
16supplemental payment amount shall be adjusted annually to

1reflect changes in the cost of living and other pertinent
2factors. The supplemental payments under this Section shall
3also be available to undocumented residents who: (i) have a
4disability, with supporting documentation meeting requirements
5determined by the Department by rule; (ii) have an Individual
6Taxpayer Identification Number; and (iii) are determined by
7the Department to meet the eligibility requirements for
8Supplemental Security Income other than the requirements
9related to status as a citizen or as an alien determined by the
10federal government to be eligible.
11    Subject to federal approval, the supplemental payments
12provided under this Section shall not be considered income for
13purposes of determining eligibility or the amount of
14assistance for any public aid benefit provided under State or
15federal law, including, but not limited to, benefits provided
16under the Medical Assistance Program established under Article
17V of this Code, personal care benefits and other services
18provided under the Community Care Program established under
19Section 4.02 of the Illinois Act on the Aging, benefits
20provided under the Supplemental Nutrition Assistance Program,
21or any housing voucher or rental subsidy provided under the
22Rental Housing Support Program Act or under a similar locally
23funded rent subsidy program, or under the Housing Choice
24Voucher Program under Section 8 of the United States Housing
25Act of 1937.
26    The Illinois Supplemental Payments for Supplemental

1Security Income Recipients Fund is created as a special fund
2in the State treasury. The Fund shall consist of the proceeds
3collected under subsection (d) of Section 3 and subsection (c)
4of Section 4 of the Illinois Estate and Generation-Skipping
5Transfer Tax Act. Moneys in the Fund shall be expended for the
6supplemental payments provided under this Section and for no
7other purpose. All interest earned on moneys in the Fund shall
8be deposited into the Fund.
 
9    Section 99. Effective date. This Act takes effect upon
10becoming law, except that Section 15 takes effect one year
11after this Act becomes law.".
