AMENDMENT TO HOUSE BILL 3949

2    AMENDMENT NO. ______. Amend House Bill 3949 by replacing
3everything after the enacting clause with the following:
 
4    "Section 1. Purpose. The purpose of this Act is to help
5homeless service providers receive federal resources during
6public health emergencies, including personal protective
7equipment for which the Federal Emergency Management Agency
8has final authority for reimbursement.
 
9    Section 5. The Department of Public Health Powers and
10Duties Law of the Civil Administrative Code of Illinois is
11amended by adding Section 2310-434 as follows:
 
12    (20 ILCS 2310/2310-434 new)
13    Sec. 2310-434. Homeless service providers.
14    (a) In this Section, "homeless service provider" means a
15person or entity who provides services to homeless persons

1under any of the programs of or identified by the Department of
2Human Services.
3    (b) The Department shall consider all homeless service
4providers in the State to be essential critical infrastructure
5workers in accordance with the most recent guidance from the
6federal Cybersecurity and Infrastructure Security Agency. The
7Department shall ensure that homeless service providers
8qualify for the same priority benefits afforded to frontline
9workers by the State, including, but not limited to:
10        (1) federal funding for relief relating to public
11    health emergencies;
12        (2) personal protective equipment; and
13        (3) vaccinations.
14    (c) In accordance with this Section, during a
15federally-designated public health emergency or a public
16health disaster declared by a proclamation issued by the
17Governor under Section 7 of the Illinois Emergency Management
18Agency Act, the Department and the Illinois Emergency
19Management Agency shall offer recommendations to their local
20counterparts, including local public health departments and
21local emergency management assistance agencies, encouraging
22them to consider homeless service providers when making
23determinations about providing assistance.
24    (d) The Department may adopt rules for the implementation
25and administration of this Section and to ensure that homeless
26service providers are considered essential critical

1infrastructure workers in the event of a pandemic.
 
2    Section 99. Effective date. This Act takes effect upon
3becoming law.".
