SYNOPSIS AS INTRODUCED:
 
20 ILCS 105/4.02h new

    Amends the Illinois Act on the Aging. Provides that the amendatory Act applies to any person who is employed by the Department on Aging, or is contracted with the Department, to provide direct services to individuals enrolled in the Community Care Program. Requires dementia training of at least 2 hours to be completed at the start of employment with the Department or contractor. Provides that persons who are employees of the Department or a contractor on the effective date of the amendatory Act shall complete this training within 6 months after the effective date of the amendatory Act. Requires the training to cover the following subjects: Alzheimer's disease and dementia, safety risks, and communication and behavior. Requires annual continuing education training to include at least 2 hours of dementia training covering those subjects. Provides that if laws or rules existing on the effective date of the amendatory Act contain more rigorous training requirements for employees or contractors providing direct services to Community Care Program enrollees, those laws or rules shall apply. Provides that where there is overlap between the provisions of the amendatory Act and other laws and rules, the Department shall interpret the provisions of the amendatory Act to avoid duplication of requirements while ensuring that the minimum requirements set in the amendatory Act are met.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Act on the Aging is amended by
5adding Section 4.02h as follows:
 
6    (20 ILCS 105/4.02h new)
7    Sec. 4.02h. Community Care Program; dementia training.    
8    (a) This Section shall apply to any person who is employed
9by the Department, or is contracted with the Department, to
10provide direct services to individuals enrolled in the
11Community Care Program.
12    (b) Dementia training of at least 2 hours shall be
13completed at the start of employment with the Department or
14contractor. Persons who are employees of the Department or a
15contractor on the effective date of this amendatory Act of the
16102nd General Assembly shall complete this training within 6
17months after the effective date of this amendatory Act of the
18102nd General Assembly. The training shall cover the following
19subjects:
20        (1) Alzheimer's disease and dementia.
21        (2) Safety risks.
22        (3) Communication and behavior.
23    (c) Annual continuing education training shall include at

3    (d) This Section is designed to address gaps in current
4dementia training requirements for Community Care Program
5direct service workers and improve the quality of training. If
6laws or rules existing on the effective date of this
7amendatory Act of the 102nd General Assembly contain more
8rigorous training requirements for employees or contractors
9providing direct services to Community Care Program enrollees,
10those laws or rules shall apply. Where there is overlap
11between this Section and other laws and rules, the Department
12shall interpret this Section to avoid duplication of
13requirements while ensuring that the minimum requirements set
14in this Section are met.
15    (e) The Department may adopt rules for the administration
16of this Section.
