Amends the Environmental Protection Act. Requires public water supply operators to notify specified health care facilities at least 30 days prior to any known, planned, or anticipated disruption event and within one hour after being aware of an unplanned disruption event. Provides that any planned or unplanned disruption event notification sent to a health care facility shall be sent to the Environmental Protection Agency and the Department of Public Health and shall be posted on the public water supply operator's website. Contains notification requirements. Contains other provisions. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Environmental Protection Act is amended by |
5 | | adding Section 19.11 as follows: |
6 | | (415 ILCS 5/19.11 new) |
7 | | Sec. 19.11. Public water supply disruption; notification. |
8 | | (a) In this Section: |
9 | | "Health care facility" means a facility, hospital, or |
10 | | establishment licensed or organized under the Ambulatory |
11 | | Surgical Treatment Center Act, the University of Illinois |
12 | | Hospital Act, the Hospital Licensing Act, the Nursing Home |
13 | | Care Act, the Assisted Living and Shared Housing Act, or the |
14 | | Community Living Facilities Licensing Act. |
15 | | "Health care facility list" means a list enumerating |
16 | | health care facilities and their designees that are served by |
17 | | a public water supply and maintained by a public water supply |
18 | | operator. |
19 | | "Public water supply" has the same meaning as defined in |
20 | | Section 3.365. |
21 | | "Public water supply operator" means a municipal or |
22 | | private corporation, individual private ownership, or a |
23 | | regularly organized body governed by a constitution and |

1 | | by-laws requiring regular election of officers under which a |
2 | | public water supply is under the direct supervision of. |
3 | | "State agencies" means the Illinois Environmental |
4 | | Protection Agency and the Illinois Department of Public |
5 | | Health. |
6 | | (b) A public water supply operator shall notify all health |
7 | | care facilities on the public water supply's health care |
8 | | facility list at least 30 days prior to any known, planned, or |
9 | | anticipated disruption event. This requirement includes any |
10 | | disruption event that could or should be reasonably |
11 | | anticipated by a public water supply operator. A known, |
12 | | planned, or anticipated disruption event includes, but is not |
13 | | limited to, a construction activity, water and sewer system |
14 | | maintenance, source water disturbance or maintenance, change |
15 | | to chemical treatment or disinfectant, lead pipe and water |
16 | | infrastructure replacement, and change to water sourcing, |
17 | | pressure, or flow. |
18 | | (c) A public water supply operator shall notify all health |
19 | | care facilities served by the public water supply that are |
20 | | affected by an unplanned disruption event in the public water |
21 | | supply's water distribution system within one hour after being |
22 | | aware of the unplanned disruption event. An unplanned |
23 | | disruption event includes, but is not limited to, a flooding, |
24 | | water main break, system failure and disruption, equipment |
25 | | failure, chemical and disinfectant treatment interruption, |
26 | | severe storm, earthquake, major fire, flow change, and other |

1 | | known or discovered water pressure loss that lowers the public |
2 | | water supply's operating pressure below 20 PSI. |
3 | | (d) A health care facility shall designate a contact |
4 | | person for the health care facility list who will receive |
5 | | electronic notifications from the public water supply operator |
6 | | when there is a planned or unplanned disruption to the health |
7 | | care facility's water supply. |
8 | | (e) Any planned or unplanned disruption event notification |
9 | | sent to a health care facility under this Section shall also be |
10 | | sent to the State agencies. Notification shall also be posted |
11 | | on the public water supply operator's website that is |
12 | | accessible to the public. The State agencies shall establish |
13 | | and maintain a list of notifications that shall be represented |
14 | | graphically on a map of Illinois and posted on a publicly |
15 | | accessible website. The website shall be available to the |
16 | | public no later than 150 days after the effective date of this |
17 | | amendatory Act of the 102nd General Assembly. |
18 | | The notice required under this Section shall include, but |
19 | | shall not be limited to, the following: |
20 | | (1) The specifics that define the planned or unplanned |
21 | | disruption event. |
22 | | (2) The date, time, and location of the planned or |
23 | | unplanned disruption event. |
24 | | (3) Any action undertaken to correct the planned or |
25 | | unplanned disruption event. |
