AMENDMENT TO HOUSE BILL 4988

2    AMENDMENT NO. ______. Amend House Bill 4988 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Environmental Protection Act is amended by
5adding Section 19.11 as follows:
 
6    (415 ILCS 5/19.11 new)
7    Sec. 19.11. Public water supply disruption; notification.
8    (a) In this Section:
9    "Disruption event" means any:
10        (1) change to a disinfection technique, practice, or
11    technology that could change disinfectant levels in the
12    water within a public water supply;
13        (2) planned or unplanned work on or damage to a water
14    main;
15        (3) change in a treatment application or source of
16    water that results in an altered finished water quality;

1        (4) event that results in a public water supply's
2    operating pressure falling below 20 PSI; or
3        (5) condition that results in the issuance of a boil
4    water order.
5    "Disruption event" includes, but is not limited to, any
6water main break, system failure or disruption, equipment
7failure, chemical or disinfectant treatment interruption, or
8flooding of a public water supply operator's facilities.
9    "Health care facility" means a facility, hospital, or
10establishment licensed or organized under the Ambulatory
11Surgical Treatment Center Act, the University of Illinois
12Hospital Act, the Hospital Licensing Act, the Nursing Home
13Care Act, the Assisted Living and Shared Housing Act, or the
14Community Living Facilities Licensing Act.
15    "Health care facility list" means a list enumerating
16health care facilities and their designees that are served by
17a public water supply and maintained by a public water supply
18operator.
19    "Public water supply" has the same meaning as defined in
20Section 3.365.
21    "Public water supply operator" means any of the following
22entities that are responsible for the direct supervision of a
23public water supply: a municipality, a private corporation, an
24individual private owner, or a regularly organized body
25governed by a constitution and by-laws requiring regular
26election of officers.

1    "State agencies" means the Illinois Environmental
2Protection Agency and the Illinois Department of Public
3Health.
4    "Water supply operator" means any individual trained in
5the treatment or distribution of water who has practical,
6working knowledge of the chemical, biological, and physical
7sciences essential to the practical mechanics of water
8treatment or distribution and who is capable of conducting and
9maintaining the water treatment or distribution processes of a
10public water supply, as defined in Section 3.365 of the
11Environmental Protection Act, in a manner that will provide
12safe, potable water for human consumption.
13    (b) A public water supply operator, through its designated
14employees or contractors, shall notify its public water supply
15operator and all health care facilities on the public water
16supply's health care facility list not more than 30 days or
17fewer than 15 days before any known, planned, or anticipated
18disruption event. An anticipated disruption event includes for
19purposes of this subsection (b) any disruption event that
20could or should be reasonably anticipated by a public water
21supply operator.
22    (c) A public water supply operator, through its designated
23employees or contractors, shall notify its water supply
24operator and all health care facilities that are served by the
25public water supply and affected by any unplanned disruption
26event in the public water supply's water distribution system.

1The notification required under this subsection (c) shall be
2provided within 2 hours after the public water supply operator
3becomes aware of the unplanned disruption event.
4    (d) A health care facility shall designate an email
5address to receive electronic notifications from the public
6water supply operator concerning planned or unplanned
7disruption events. The email account shall be accessible to
8the health care facility's designated water management plan
9administrator and other responsible administrative personnel.
10    (e) Any planned or unplanned disruption event notification
11sent to a health care facility under this Section shall also be
12sent to the State agencies within 5 business days.
13Notification shall also be posted on the public water supply
14operator's website that is accessible to the public if such a
15website existed as of January 1, 2022. A public water supply
16operator may provide notification to its customers and the
17public on a social media website rather than posting the
18required notice on its website if (1) the public water supply
19operator uses the social media website to regularly
20communicate with its customers; (2) the social media website
21is accessible to the general public; and (3) the social media
22website's use will reduce the timeframe for customer
23notification. The State agencies shall establish, maintain,
24and retain a list of notifications received pursuant to this
25subsection (e).
26    The notice required under this Section shall include, but

1shall not be limited to, the following:
2        (1) a detailed description of the disruption event;
3        (2) the date, time, and location of the disruption
4    event;
5        (3) the expected time needed to resolve the disruption
6    event; and
7        (4) a list of the health care facilities notified by
8    the public water supply operator.
9    Beginning one year after the effective date of this
10amendatory Act of the 102nd General Assembly, the State
11agencies shall make available upon request a list of
12disruption events, in an electronic format, sorted by the year
13and month of each occurrence.
 
14    Section 99. Effective date. This Act takes effect upon
15becoming law.".
