1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Highway Code is amended by adding
5Section 9-112.6 as follows:
 
6    (605 ILCS 5/9-112.6 new)
7    Sec. 9-112.6. Vegetation control permit.
8    (a) The Department may provide for vegetation control on
9land or a right-of-way under its jurisdiction related to the
10visibility of a permitted or registered outdoor advertising
11sign or grant a permit for such work.
12    (b) The Department may issue rules to provide the
13standards and procedures for vegetation control, including,
14but not limited to, permit applications, permits, revocations,
15and the requirements for the replacement of vegetation and
16landscaping removal to establish clear visibility zones of
17signs along highways in the State under its jurisdiction.
18    (c) The Department shall allow the cutting or trimming of
19vegetation to clear a visibility zone 250 feet in front of a
20single-sided sign and 250 feet in front of each side of a
21double-sided sign. The visibility zone for signs shall also
22include an additional 250-foot triangular section measured
23diagonally from the edge of the right-of-way to the edge of

1pavement. This distance shall be measured from the edge of the
2sign face closest to the pavement in a direction parallel to
3the pavement. All cutting or trimming of vegetation shall
4maintain environmental compliance and in no event shall the
5cutting or trimming of vegetation violate safety rules of the
6Department.
7    (d) The Department shall process a completed vegetation
8control application within 45 days of receiving such an
9application.
 
10    Section 99. Effective date. This Act takes effect 3 months
11after becoming law.
