SYNOPSIS AS INTRODUCED:

70 ILCS 705/16.06d new

    Amends the Illinois Municipal Code and the Fire Protection District Act. Provides that a person applying for a position in a fire department or fire protection district must disclose if he or she has been convicted, arrested, or charged with arson, aggravated arson, or criminal damage to property due to recklessly, by means of fire, damaging the property of another or knowingly starting a fire on the land of another. Provides that the person or board hiring an individual who has applied to a position in a fire department or fire protection district may take into consideration the disclosed convictions, arrests, or charges in the hiring or retention of the applicant. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Municipal Code is amended by
5adding Section 11-6-12 as follows:
 
6    (65 ILCS 5/11-6-12 new)
7    Sec. 11-6-12. Disclosure of offenses
8    (a) Notwithstanding any other provisions of law, a person
9applying for a position in a fire department must disclose if
10he or she has been convicted, arrested, or charged with arson,
11aggravated arson, or criminal damage to property due to
12recklessly, by means of fire, damaging the property of another
13or knowingly starting a fire on the land of another.
14    (b) The person or board hiring an individual who has
15applied to a position in a fire department may take into
16consideration the item or items disclosed under subsection (a)
17in the hiring or retention of the applicant.
 
18    Section 10. The Fire Protection District Act is amended by
19adding Section 16.06d as follows:
 
20    (70 ILCS 705/16.06d new)
21    Sec. 16.06d. Disclosure of offenses.
