SYNOPSIS AS INTRODUCED:
 
105 ILCS 5/9-27 new

    Amends the School Code. Provides that, in an elementary district that is located entirely within a municipality with less than 50,000 inhabitants, a proposition to require members of the board of education to be appointed by the mayor or president of the municipality, rather than being elected, shall be certified by the secretary of the board of education to the proper election authority if a petition requesting the proposition is signed by electors of the school district numbering not less than 10% of the total vote cast at the last election for mayor or president of the municipality and the petition is filed with the secretary of the board of education. Requires the election authority to submit the proposition at an election in accordance with the Election Code. Specifies the requirement for the form of such a proposition. Provides that if a majority of those voting on the proposition vote in favor of it, all existing terms of the board or education members shall expire on the date of the next regular election of board of education members or when a successor is appointed and qualified, whichever is later, and their successors shall be appointed by the mayor of the municipality for terms of 2 years.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by adding Section
59-27 as follows:
 
6    (105 ILCS 5/9-27 new)
7    Sec. 9-27. Changing from election to appointment of
8members of a board of education; elementary district within a
9municipality of less than 50,000 inhabitants. Notwithstanding
10any other provision of law to the contrary, in an elementary
11district that is located entirely within a municipality with
12less than 50,000 inhabitants, a proposition to require members
13of the board of education to be appointed by the mayor or
14president of the municipality, rather than being elected,
15shall be certified by the secretary of the board of education
16to the proper election authority if a petition requesting the
17proposition is signed by electors of the school district
18numbering not less than 10% of the total vote cast at the last
19election for mayor or president of the municipality and the
20petition is filed with the secretary of the board of
21education.
22    Upon receipt of a petition that meets the requirements of
23this Section from the secretary of the board of education, the

1election authority shall submit the proposition at an election
2in accordance with the Election Code. The proposition shall be
3in substantially the following form:
4        Shall members of the Board of Education of (name of
5    elementary school district) be appointed by the
6    (Mayor/President) of (name of municipality)?
7    The election authority must record the votes as "Yes" or
8"No". If a majority of those voting on the proposition vote in
9favor of it, all existing terms of the board of education
10members shall expire on the date of the next regular election
11of board of education members or when a successor is appointed
12and qualified, whichever is later, and their successors shall
13be appointed by the mayor or president of the municipality for
14terms of 2 years.
