Amends the Illinois Procurement Code. Strikes a provision requiring the Department of Central Management Services to report to the General Assembly on specified annual reports produced by each State agency. Provides that each State agency that purchases food through a contract procured in accordance with the Code shall adopt a policy that permits the donation of leftover food purchased with State funds. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The Illinois Procurement Code is amended by |
5 | | changing Sections 25-55 and 55-20 as follows:
|
6 | | (30 ILCS 500/25-55)
|
7 | | Sec. 25-55. Annual reports. Every printed annual report
|
8 | | produced by a State agency
shall bear a statement indicating |
9 | | whether it was printed by the
State of Illinois or by contract
|
10 | | and indicating the printing cost per copy and the number of |
11 | | copies
printed. The Department
of Central Management Services |
12 | | shall prepare and submit to the
General Assembly on the fourth
|
13 | | Wednesday of January in each year a report setting forth with
|
14 | | respect to each State agency for
the calendar year immediately |
15 | | preceding the calendar year in which
the report is filed the |
16 | | total
quantity of annual reports printed, the total cost, and |
17 | | the cost
per copy and the cost per page of the
annual report of |
18 | | the State agency printed during the calendar year
covered by |

2 | | (a) After the effective date of this amendatory Act of the |
3 | | 99th General Assembly, a public entity shall not enter into a |
4 | | contract to purchase food with a bidder or offeror if the |
5 | | bidder's or offeror's contract terms prohibit the public |
6 | | entity from donating food to food banks, including, but not |
7 | | limited to, homeless shelters, food pantries, and soup |
8 | | kitchens.

9 | | (b) Each State agency that purchases food through a |
10 | | contract procured in accordance with entering into or |
11 | | maintaining a contract for the purchase of food under this |
12 | | Code shall adopt a policy that permits the donation of |
13 | | leftover food purchased with procured by State funds. The |
14 | | policy shall address any daily food operations run by the |
15 | | agency, including one-time events, and shall contain a list of |
16 | | nearby soup kitchens, food pantries, and other non-profit |
17 | | organizations where leftover food can be donated. Each State |
18 | | agency shall circulate its policy to all agency employees, and |
19 | | submit its food donation policy to the Department of Central |
20 | | Management Services on an annual basis beginning December 31, |
21 | | 2018. |
