    Amends the Environmental Protection Act. Makes a technical change in a Section concerning agrichemical facility or lawncare containment permit endorsement.

1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Environmental Protection Act is amended by
5changing Section 39.4 as follows:
 
6    (415 ILCS 5/39.4)  (from Ch. 111 1/2, par. 1039.4)
7    Sec. 39.4. (a) Upon receipt of a joint application
8transmitted from the the Department of Agriculture for an
9agrichemical facility construction or operation permit or a
10lawncare containment permit, the Agency may provide a written
11endorsement of the permit to be issued by the Department for
12such agrichemical facility or lawncare wash water containment
13area. The Agency's endorsement may be provided at any time
14prior to final action by the Department regarding the subject
15permit.
16    (b) For all purposes of this Act, an agrichemical facility
17permit or lawncare containment permit endorsed by the Agency
18pursuant to this Section shall be deemed to be a permit issued
19by the Agency pursuant to subsection (b) of Section 9 and
20subsection (b) of Section 12 of this Act. An agrichemical
21facility or a lawncare wash water containment area remains
22subject to all applicable permit requirements under this Act
23if the Department of Agriculture's agrichemical facility

1permit or lawncare containment permit has not been endorsed
2pursuant to subsection (a) of this Section.
3    (c) An agrichemical facility permit or a lawncare
4containment permit endorsed by the Agency shall not be subject
5to the annual fee provisions of Section 9.6 of this Act.
