SYNOPSIS AS INTRODUCED:
 
305 ILCS 5/5-5.07

    Provides that if and only if Senate Bill 1510 of the 101st General Assembly becomes law, then the Medical Assistance Article of the Illinois Public Aid Code is amended by making a provision that concerns the DCFS per diem rates for inpatient psychiatric stays operative through July 1, 2023 (rather than through June 30, 2021). Effective immediately or on the date Senate Bill 1510 of the 101st General Assembly takes effect, whichever is later.

1    AN ACT concerning public aid.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. If and only if Senate Bill 1510 of the 101st
5General Assembly becomes law, then the Illinois Public Aid
6Code is amended by changing Section 5-5.07 as follows:
 
7    (305 ILCS 5/5-5.07)
8    Sec. 5-5.07. Inpatient psychiatric stay; DCFS per diem
9rate. The Department of Children and Family Services shall pay
10the DCFS per diem rate for inpatient psychiatric stay at a
11free-standing psychiatric hospital effective the 11th day when
12a child is in the hospital beyond medical necessity, and the
13parent or caregiver has denied the child access to the home and
14has refused or failed to make provisions for another living
15arrangement for the child or the child's discharge is being
16delayed due to a pending inquiry or investigation by the
17Department of Children and Family Services. If any portion of
18a hospital stay is reimbursed under this Section, the hospital
19stay shall not be eligible for payment under the provisions of
20Section 14-13 of this Code. This Section is inoperative on and
21after July 1, 2021. Notwithstanding the provision of Public
22Act 101-209 stating that this Section is inoperative on and
23after July 1, 2020, this Section is operative from July 1, 2020

4    Section 99. Effective date. This Act takes effect upon
5becoming law or on the date Senate Bill 1510 of the 101st
6General Assembly takes effect, whichever is later.
