2 | AMENDMENT NO. ______. Amend Senate Bill 658 by replacing | ||||||
3 | everything after the enacting clause with the following:
| ||||||
4 | "Section 5. The Emergency Telephone System Act is amended | ||||||
5 | by changing Section 3 as follows:
| ||||||
6 | (50 ILCS 750/3) (from Ch. 134, par. 33)
| ||||||
7 | (Section scheduled to be repealed on December 31, 2023)
| ||||||
8 | Sec. 3.
(a) By July 1, 2017, every local public agency | ||||||
9 | shall be within the jurisdiction of a 9-1-1 system.
| ||||||
10 | (b) Within 18 months of the awarding of a contract to a | ||||||
11 | vendor certified under Section 13-900 of the Public Utilities | ||||||
12 | Act to provide Next Generation 9-1-1 service, every 9-1-1 | ||||||
13 | system in Illinois, except in a municipality with a population | ||||||
14 | over 500,000, shall provide Next Generation 9-1-1 service. A | ||||||
15 | municipality with a population over 500,000 shall provide Next | ||||||
16 | Generation 9-1-1 service by December 31, 2023. |

1 | Notwithstanding any provision of the Illinois Municipal | ||||||
2 | Code, a 9-1-1 vendor under Section 13-900 of the Public | ||||||
3 | Utilities Act must give written notice to the municipality it | ||||||
4 | has a contract with or for which it currently provides | ||||||
5 | emergency services not less than 12 months prior to | ||||||
6 | termination of services. If an emergency services contract is | ||||||
7 | terminated, the provider may not increase the fees of any | ||||||
8 | remaining contract by more than 3% of the fees from the | ||||||
9 | previous year. A private sector company that terminates the | ||||||
10 | emergency services contract prior to the natural expiration of | ||||||
11 | the contract term and that seeks an increase in the annual | ||||||
12 | contract value of more than 10% is barred from contracting | ||||||
13 | with any units of local government or entities that receive | ||||||
14 | funding for emergency services for a period of 5 years from the | ||||||
15 | date of the notice of contract termination. As used in this | ||||||
16 | paragraph, "emergency services" includes, but is not limited | ||||||
17 | to, dispatch, 9-1-1, paramedic, or ambulance services. | ||||||
18 | (c) Nothing in this Act shall be construed to prohibit or
| ||||||
19 | discourage in any way the formation of multijurisdictional or | ||||||
20 | regional
systems, and any system established pursuant to this | ||||||
21 | Act may include the
territory of more than one public agency or | ||||||
22 | may include a segment of the
territory of a public agency.

24 | Section 10. The Emergency Medical Services (EMS) Systems | ||||||
25 | Act is amended by adding Section 3.260 as follows: |

2 | Sec. 3.260. Contracts with municipalities. Notwithstanding | ||||||
3 | any provision of the Illinois Municipal Code, a 9-1-1 vendor | ||||||
4 | under Section 13-900 of the Public Utilities Act must give | ||||||
5 | written notice to the municipality it has a contract with or | ||||||
6 | for which it currently provides emergency services not less | ||||||
7 | than 12 months prior to termination of services. If an | ||||||
8 | emergency services contract is terminated, the provider may | ||||||
9 | not increase the fees of any remaining contract by more than 3% | ||||||
10 | of the fees from the previous year. A private sector company | ||||||
11 | that terminates the emergency services contract prior to the | ||||||

21 | Section 99. Effective date. This Act takes effect upon | ||||||
22 | becoming law.".
