AMENDMENT TO SENATE BILL 1078

2    AMENDMENT NO. ______. Amend Senate Bill 1078, AS AMENDED,
3with reference to page and line numbers of Senate Amendment
4No. 2, as follows:
 
5on page 7, line 21, after "therapist", by inserting "or
6occupational therapy assistant"; and
 
7on page 8, line 9, after "therapist", by inserting "or
8licensed occupational therapy assistant"; and
 
9on page 8, line 12, after "Sections 1", by inserting ", 1.2,";
10and
 
11on page 12, immediately below line 11, by inserting the
12following:

1    (Section scheduled to be repealed on January 1, 2026)
2    Sec. 1.2. Physical therapy services.
3    (a) A physical therapist may provide physical therapy
4services to a patient with or without a referral from a health
5care professional.
6    (b) A physical therapist providing services without a
7referral from a health care professional must notify the
8patient's treating health care professional within 5 business
9days after the patient's first visit that the patient is
10receiving physical therapy. This does not apply to physical
11therapy services related to fitness or wellness, unless the
12patient presents with an ailment or injury.
13    (b-5) A physical therapist providing services to a patient
14who has been diagnosed by a health care professional as having
15a chronic disease that may benefit from physical therapy must
16communicate at least monthly with the patient's treating
17health care professional to provide updates on the patient's
18course of therapy.
19    (c) A physical therapist shall refer a patient to the
20patient's treating health care professional of record or, in
21the case where there is no health care professional of record,
22to a health care professional of the patient's choice, if:
23        (1) the patient does not demonstrate measurable or
24    functional improvement after 10 visits or 15 business
25    days, whichever occurs first, and continued improvement
26    thereafter;

1        (2) the patient was under the care of a physical
2    therapist without a diagnosis established by a health care
3    professional of a chronic disease that may benefit from
4    physical therapy and returns for services for the same or
5    similar condition after 30 calendar days of being
6    discharged by the physical therapist; or
7        (3) the patient's condition, at the time of evaluation
8    or services, is determined to be beyond the scope of
9    practice of the physical therapist.
10    (d) Wound debridement services may only be provided by a
11physical therapist with written authorization from a health
12care professional.
13    (e) A physical therapist shall promptly consult and
14collaborate with the appropriate health care professional
15anytime a patient's condition indicates that it may be related
16to temporomandibular disorder so that a diagnosis can be made
17by that health care professional for an appropriate treatment
18plan.
