1 | | AN ACT concerning education.
|
2 | | Be it enacted by the People of the State of Illinois, |
3 | | represented in the General Assembly:
|
4 | | Section 5. The School Construction Law is amended by |
5 | | changing Section 5-40 as follows:
|
6 | | (105 ILCS 230/5-40)
|
7 | | Sec. 5-40. Supervision of school construction projects; |
8 | | green projects. The Capital
Development Board shall exercise |
9 | | general supervision over school construction
projects financed |
10 | | pursuant to this Article. School districts, however, must be |
11 | | allowed to choose the architect and engineer for their school |
12 | | construction projects, and no project may be disapproved by |
13 | | the State Board of Education or the Capital Development Board |
14 | | solely due to a school district's selection of an architect or |
15 | | engineer.

16 | | With respect to those school construction projects for |
17 | | which a school district first applies for a grant on or after |
18 | | July 1, 2007, the school construction project must receive |
19 | | certification from the United States Green Building Council's |
20 | | Leadership in Energy and Environmental Design Green Building |
21 | | Rating System or the Green Building Initiative's Green Globes |
22 | | Green Building Rating System or must meet green building |
23 | | standards of the Capital Development Board and its Green |

1 | | Building Advisory Committee. With respect to those school |
2 | | construction projects for which a school district applies for |
3 | | a grant on or after July 1, 2009, the school construction |
4 | | project must receive silver certification from the United |
5 | | States Green Building Council's Leadership in Energy and |
6 | | Environmental Design Green Building Rating System unless all |
7 | | of the following are met: |
8 | | (1) (blank); the application submitted can be |
9 | | categorized as a capital need prioritized under item (1) |
10 | | of Section 5-30 of this Law; |
11 | | (2) (blank); the renovation or replacement school |
12 | | construction project is less than 40% replacement cost, or |
13 | | the project has been granted a waiver by the Capital |
14 | | Development Board in consultation with the State Board of |
15 | | Education in accordance with rules promulgated pursuant to |
16 | | this Law; |
17 | | (3) the school construction project is located in a |
18 | | county with a population of more than 38,000 and less than |
19 | | 39,000 that borders the Mississippi River with a |
20 | | population of more than 33,000 and less than 34,000 , |
21 | | according to the 2010 decennial census; |
22 | | (4) the school district for which the school |
23 | | construction grant will be issued has no more than 500 |
24 | | 1,100 students, with the relevant school facility housing |
25 | | no more than 150 700 students; |
26 | | (5) the facilities for which the school construction |

1 | | grant will be used have been in use as of August 2019 |
2 | | condemned as of July 23, 2012 ; and |
3 | | (6) the application for the school construction grant |
4 | | has been approved prior to the effective date of this |
5 | | amendatory Act of the 102nd 98th General Assembly.

7 | | Section 99. Effective date. This Act takes effect upon |
8 | | becoming law.
