2 | | AMENDMENT NO. ______. Amend Senate Bill 1490, AS AMENDED, |
3 | | by replacing everything after the enacting clause with the |
4 | | following:

5 | | "Section 5. The Illinois and Michigan Canal Development |
6 | | Act is amended by adding Section 14.1 as follows: |
7 | | (615 ILCS 45/14.1 new) |
8 | | Sec. 14.1. Exchange of property. |
9 | | (a) Notwithstanding any other provision of law or |
10 | | restriction on the property, including, but not limited to, |
11 | | any State rights, easements, or conveyance and reversion |
12 | | clauses restricting sale, the Village of Lemont may exchange |
13 | | with a nongovernmental entity any Illinois and Michigan Canal |
14 | | lands that are purchased from the State for other real |
15 | | property of substantially equal or greater value, as |
16 | | determined by 2 MAI appraisals of the properties, and of |

1 | | substantially the same or greater suitability for |
2 | | recreational, park, and parking purposes without additional |
3 | | cost to the Village. However, the property being transferred |
4 | | to the Village must be continuous to other Illinois and |
5 | | Michigan Canal lands owned by the Village. |
6 | | (b) Prior to an exchange under subsection (a) with a |
7 | | nongovernmental entity, the Village board shall hold a public |
8 | | hearing in order to consider the proposed exchange. Notice of |
9 | | such meeting shall be published at least twice, with the first |
10 | | and last publication being at least 10 days apart, in a |
11 | | newspaper of general circulation within the Village. |
12 | | (c) This Section applies to the exchange of Parcel One |
13 | | owned by the Village for Parcel Two owned by a nongovernmental |
14 | | entity as follows: |

17 | | OF THE THIRD PRINCIPAL MERIDIAN, ALL IN COOK COUNTY, |
