AMENDMENT TO SENATE BILL 1490

2    AMENDMENT NO. ______. Amend Senate Bill 1490, AS AMENDED,
3by replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Illinois and Michigan Canal Development
6Act is amended by adding Section 14.1 as follows:
 
7    (615 ILCS 45/14.1 new)
8    Sec. 14.1. Exchange of property.
9    (a) Notwithstanding any other provision of law or
10restriction on the property, including, but not limited to,
11any State rights, easements, or conveyance and reversion
12clauses restricting sale, the Village of Lemont may exchange
13with a nongovernmental entity any Illinois and Michigan Canal
14lands that are purchased from the State for other real
15property of substantially equal or greater value, as
16determined by 2 MAI appraisals of the properties, and of

1substantially the same or greater suitability for
2recreational, park, and parking purposes without additional
3cost to the Village. However, the property being transferred
4to the Village must be continuous to other Illinois and
5Michigan Canal lands owned by the Village.
6    (b) Prior to an exchange under subsection (a) with a
7nongovernmental entity, the Village board shall hold a public
8hearing in order to consider the proposed exchange. Notice of
9such meeting shall be published at least twice, with the first
10and last publication being at least 10 days apart, in a
11newspaper of general circulation within the Village.
12    (c) This Section applies to the exchange of Parcel One
13owned by the Village for Parcel Two owned by a nongovernmental
14entity as follows:
 
15    PARCEL ONE:
 
16    THAT PART OF SECTION 20, TOWNSHIP 37 NORTH, RANGE 11 EAST
17    OF THE THIRD PRINCIPAL MERIDIAN, ALL IN COOK COUNTY,
18    ILLINOIS, DESCRIBED AS FOLLOWS:
 
19    BEGINNING AT THE INTERSECTION OF THE SOUTH LINE OF THE
20    SOUTHERNLY 90 FOOT RESERVE STRIP OF THE ILLINOIS AND
21    MICHIGAN CANAL AND THE NORTHEAST CORNER OF LOT 1 IN BLOCK 1
22    IN THE PLAT OF THE VILLAGE OF LEMONT, RECORDED AUGUST 8,
23    1874 AS DOCUMENT 184242; THENCE ALONG A LINE 141 FEET

4    RIGHT ANGLES THERETO) AND PARALLEL WITH THE EASTERLY LINE
5    OF BLOCK 1 IN SAID VILLAGE OF LEMONT SUBDIVISION, EXTENDED
6    NORTHWESTERLY; THENCE ALONG A LINE 139 FEET PARALLEL WITH
7    CANAL STREET; THENCE ALONG A LINE 63 FEET SOUTHEASTERLY TO
