2 | | Sec. 9. Any dog found running at large contrary to |
3 | | provisions of this Act
may
be apprehended and impounded. For |
4 | | this purpose, the Administrator shall
utilize any existing or |
5 | | available animal control facility or licensed animal shelter. |
6 | | The dog's owner shall pay a $25 public safety fine to be |
7 | | deposited into the county animal control fund or the county |
8 | | pet population control fund. Funds transferred to or retained |
9 | | by a municipality before the effective date of this amendatory |
10 | | Act of the 100th General Assembly under this paragraph shall |
11 | | continue to be transferred to and be retained by that |
12 | | municipality. A dog found running at large contrary to the |
13 | | provisions of this Act a second or subsequent time must be |
14 | | sterilized spayed or neutered within 30 days after being |
15 | | reclaimed unless already sterilized spayed or neutered ; |
16 | | failure to comply shall result in impoundment.

17 | | A dog that is actively engaged in a legal hunting |
18 | | activity, including training, is not considered to be running |
19 | | at large if the dog is on land that is open to hunting or on |
20 | | land on which the person has obtained permission to hunt or to |
21 | | train a dog. A dog that is in a dog-friendly area or dog park |
22 | | is not considered to be running at large if the dog is |
23 | | monitored or supervised by a person.
